Bank Account Freeze Lawyer: Identify the Order and Remedy

A bank account freeze lawyer first identifies who legally restricted the account: the bank, a sanctions authority, a criminal court, or a creditor acting through a civil court. The document behind the restriction determines which body can change it, what evidence matters, and whether there is an immediate hearing or complaint deadline. There is no single international application that releases every frozen account, and a bank cannot disregard a binding order simply because a customer disputes it.

What exactly stopped working, and who made the decision?

“Account frozen” may mean a disabled login, a delayed incoming payment, suspended withdrawals, a ring-fenced balance or a court order restricting wider assets. These are legally different. A payment rejected before execution also differs from funds received and formally blocked. Record the affected accounts, currency, amount, transaction dates, countries of the bank and sender, and whether other signatories can still operate the account.

Ask the provider in writing for the restriction's effective date, scope, any disclosable order or reference number, and the approved channel for documents. Ask whether it is checking identity/source of funds, complying with a legal prohibition or implementing a court order. The bank may lawfully withhold some compliance information. Under the UK's Proceeds of Crime Act 2002, “tipping off” is an offence in defined regulated-sector circumstances; silence alone does not prove an unlawful freeze.

Do not treat a generic “security review” message as a court order, or assume that a refusal to explain proves no order exists. Preserve the exact message, date, support ticket and account terms. If a notice names a court, enforcement officer or sanctions programme, inspect that instrument before relying only on a bank complaint.

Freeze-source decision grid: six facts that select the remedy

Who imposed or triggered the restriction? Document or legal foundation to identify Competent decision-maker or forum Evidence to assemble Lawful remedy to test Urgency signal
Bank's own risk/compliance team Account terms, requests for customer due diligence, payment rejection or closure notice Bank complaints function; eligible disputes to the relevant ombudsman or court ID, ownership, invoices, transaction chain, bank correspondence Correct facts, request review, complain, evaluate contractual claim Salary, payroll or operating payments interrupted; ask for escalation immediately
Sanctions compliance obligation Jurisdiction, designated person, relevant measure, licence or screening match Relevant sanctions authority for licence or designation review; bank for false positive Identity distinctions, beneficial ownership, counterparties, legal purpose of funds Correct false match; seek authorisation where available; challenge designation separately Prohibited transfer must not be attempted; urgent permitted-expenses review
Criminal account freezing or restraint Sealed judicial order, enabling statute, case number, service date Issuing criminal/civil-recovery court under local statute; prosecution or enforcement body participates Order, source-of-funds audit trail, third-party interests, essential expense proof Apply to vary, set aside or obtain permitted exclusions where law allows Hearing/objection dates on the actual order, not an assumed universal period
Civil preservation injunction Claim number, judge's order, undertakings, notice and return date Court that made or supervises the injunction Ownership, lack of dissipation risk, disclosure record, living/business need Variation, discharge or narrow licence within order Short return date and possible contempt consequences
Judgment enforcement / debt attachment Judgment, enforcement title, interim attachment or third-party debt order Judgment/enforcement court or designated enforcement authority Payment history, identity, exempt assets, debtor/third-party rights Object or seek hardship/exemption relief under procedural rules Hearing and evidence deadlines; distinguish interim from final order
Cross-border transmitted freezing order Issuing and executing authorities, transmitted certificate, recognition notice Issuing state for underlying justification; executing state's court for recognition/execution remedy where law so provides Both instruments, service records, property nexus, recognition grounds Separate challenges in the legally competent states Local notification and appeal rules may run in parallel

This grid routes the first enquiry; it does not imply that every remedy exists in every country. One account may face overlapping restrictions—for example, a bank review followed by a court order, or sanctions alongside a creditor attachment. Check which restriction would remain if another were lifted. A bank complaint cannot cancel a court order, and a criminal variation does not create a sanctions licence.

A compliance restriction is not the same as an order from a court

Where a bank pauses activity for identity, fraud-prevention or anti-money-laundering checks, the immediate decision-maker is usually the institution under its applicable law and account terms. Supply a chronological explanation, invoices/contracts, beneficial-owner details and the transaction trail through the bank's approved channel. Do not omit difficult transactions from the narrative.

In the EU, Article 79 of Directive (EU) 2015/2366 generally requires a payment service provider refusing a payment order to notify the user of the refusal, possible reasons and how to correct factual errors, unless other EU or national law prohibits notice. This concerns payment orders; it is not an unrestricted right to internal alerts or a way to force a sanctioned payment. Check national implementing law and the contract.

A UK consumer or business may complain to the institution and, if eligible, use the Financial Ombudsman Service (FOS), which considers blocked payments and frozen accounts in light of the law, account terms and fairness. For a payment-services complaint within FOS compulsory jurisdiction, FCA Handbook DISP 1.6.2A normally requires a final response within 15 business days after receipt; exceptionally, a holding response is due within 15 business days and the final response within 35 business days. Regulation 101 of the Payment Services Regulations 2017 sets corresponding 15/35-day rules for users outside compulsory FOS jurisdiction. For other complaint types, DISP 1.6.2R generally provides eight weeks. These are response periods, not release deadlines. Check eligibility and referral rules: FOS referral is ordinarily due within six months of the final response, subject to exceptions.

If the bank accepts a mistaken name match, wrong ownership detail or document-review error, ask for written correction. Where a contractual breach may have occurred and an ombudsman route is unavailable or unsuitable, assess civil proceedings in the court with jurisdiction. A regulator supervises firms; it does not automatically reverse an individual court restraint.

Sanctions: was the money genuinely blocked or merely screened?

Map the applicable UK, EU, US or other regime; the institution holding the funds; the person or entity with an interest; and whether the event is a rejected payment, a blocked asset or a screening false positive. A similar name alone does not establish designation, while a person not listed by name may still be affected by ownership/control rules. The relevant sanctions text decides.

Under US rules administered by the Office of Foreign Assets Control (OFAC), FAQ 51 explains that financial institutions—not OFAC—hold blocked property and normally need OFAC authorisation to release it. FAQ 1196 addresses mistaken identity or similar errors. A compliance release under 31 CFR 501.806 is available only to the organisation that blocked the property, so a customer should contact that institution. It is not a substitute for a specific licence where a blocked person has an interest. Confirm the sanctions programme and reporting position first.

For UK asset-freeze regimes, the Office of Financial Sanctions Implementation (OFSI) describes licences and their limited grounds. Since 28 January 2026, the UK Sanctions List has been the sole official source for UK designations; the former OFSI Consolidated List is no longer the current source. A licence request differs from review or variation of a designation. A licence permits only specified activity and does not erase the designation or displace other bank duties. Check the corresponding rules under EU and other regimes. Designation-specific issues belong on the OFAC sanctions lawyer page; here, first establish whether sanctions caused the restriction.

If there is a criminal or proceeds-of-crime order, read its exact statutory power

The United Kingdom illustrates why labels matter; its rules must not be exported to other countries. Under section 303Z1 of the Proceeds of Crime Act 2002 (POCA), specified enforcement officers may seek an account freezing order (AFO) where there are reasonable grounds to suspect that account money is recoverable property or intended for unlawful conduct. The relevant court is a magistrates' court in England and Wales or Northern Ireland, and the sheriff in Scotland. Sections 303Z3–303Z4 allow the court to make, vary or set aside the order on an affected person's application. The period specified in the order cannot exceed two years from the date it was made. However, POCA separately provides for earlier termination or continuation in specified forfeiture and appeal circumstances, so the account does not necessarily become usable automatically on the second anniversary; check the order and the applicable statutory provisions.

POCA section 303Z5 allows targeted exclusions for reasonable living expenses or for carrying on a trade, business, profession or occupation, subject to conditions. In England and Wales and Northern Ireland, a magistrates’ court allowing legal expenses for proceedings under Part 5 must limit the exclusion to reasonable legal expenses and specify the total amount that may be released; additional statutory conditions apply. In Scotland, the sheriff’s power to make exclusions cannot be used to meet legal expenses for proceedings under Part 5. Check the applicable legal-aid rules and support every other requested amount. No payment is automatic.

By contrast, a criminal restraint order under POCA section 41 is made by the Crown Court in England and Wales; section 42 allows an affected person to seek variation or discharge there. It may reach assets beyond one account and has distinct investigation, trial and confiscation issues. Sending an AFO application to the magistrates' court would be the wrong route if the document is actually a Crown Court restraint order. The sealed instrument, court and statutory section—not a bank employee's label—control.

An order under another state's criminal procedure must be assessed under that state's law. Where Regulation (EU) 2018/1805 applies between participating EU states, Article 33 permits a remedy in the executing state against recognition/execution, but the substantive reasons for the order must be challenged in the issuing state, not the executing-state court. Identify both states and check national notice and filing rules; the EU Regulation does not itself supply one universal national deadline.

Civil preservation and debt enforcement require different documents

In England and Wales, CPR Part 25 governs interim measures including freezing injunctions, which preserve assets rather than determine ownership or award final damages. The issuing/supervising court handles variation or discharge. Read the return-hearing date, service rules, undertakings, disclosure duties and permitted living/business expenses in the actual order. CPR 25.13 requires affidavit or affirmation evidence for a freezing-injunction application. Disobedience can have serious consequences even if the underlying claim is disputed.

A judgment creditor may use an England and Wales third-party debt order under CPR Part 72. An interim order can require the bank to retain money pending a hearing; a final order can direct payment to the creditor. Rule 72.3 normally requires filing in the judgment court, subject to transfer and the Civil National Business Centre exception. Under rule 72.7, an individual debtor may seek a hardship payment order if ordinary living expenses cannot be met; unless the court orders otherwise, serve the creditor at least 2 days before the hearing. Rule 72.8 requires objection evidence to be filed and served as soon as possible and at least 3 days before the hearing. Check the order and hearing notice. This is not an AFO variation.

For some cross-border civil claims in participating EU states, Regulation (EU) No 655/2014 creates the European Account Preservation Order (EAPO); it does not bind Denmark or the United Kingdom. Under Article 33, a debtor generally applies to the court in the Member State of origin to revoke or modify the order. Article 33(1)(b) also provides a specific ground where the order, preservation declaration or other required documents were not served within 14 days after the account was preserved, subject to the Regulation’s cure provisions; this is not a universal 14-day deadline for every EAPO challenge. Article 34 addresses challenges to enforcement in the Member State of enforcement. Articles 35–36 add adjustment and procedural rules. Confirm the instrument’s territorial and case scope; “European bank account freeze” is not enough. International collection of an existing judgment belongs on cross-border asset recovery.

Which documents make a challenge credible?

Prepare a confidential, dated index: account agreement and holder identity; all notices; the sealed order, certificate or enforcement reference; statements showing relevant balances and entries; contracts, invoices and delivery evidence; payroll, tax and company records; and a beneficial-ownership chart naming actual controllers. For incoming transfers, map originator → intermediary → beneficiary with dates and identifiers. For a suspected sanctions false positive, provide reliable details that distinguish the customer from the listed person.

For urgent expenses, itemise rent, food, medicine, wages, tax and legal costs with amounts, evidence and due dates. Identify money owned by a third party and prove that interest. Record exactly which document was served, on whom and when: a challenge period may run from service, not discovery of the unavailable balance. Legitimate source of funds alone does not defeat a valid debt, transaction restriction or sanctions rule.

Practical first steps and the limits of legal representation

  1. Protect records and deadlines. Save the bank's wording and all court or authority documents; note receipt and service dates. If there is a hearing, obtain local procedural advice immediately.
  2. Ask a precise question of the institution. Is the block a discretionary review, a mandatory sanctions restriction, or compliance with a named order? Request the lawful disclosure channel and complaint reference.
  3. Separate mechanisms. Trace the entity controlling the decision and whether a second restriction would remain. Do not file a sanctions licence request when the operative problem is an unrelated creditor's order.
  4. Choose the proper forum. Bank complaint/ombudsman for an eligible bank-service dispute; sanctions authority for licensing or review; issuing court for the identified court order; recognised statutory procedure for cross-border execution. Confirm standing and territorial jurisdiction.
  5. Prepare a proportionate remedy. Decide whether the evidence supports correction, disclosure, narrow release for essential expenses, variation, discharge, objection or a separate damages claim. The applicable order may forbid transactions while review is pending.

The useful first-assessment deliverable is a written source-of-freeze map: verified issuer, statutory or contractual basis, territorial reach, amount affected, body empowered to change the restriction, missing evidence, service/filing trigger and next lawful step. If the bank lawfully withholds details, state what remains unconfirmed rather than inventing an agency or case number. Foreign-court representation depends on local admission, permissions and suitable counsel; a cross-border service has no automatic right of audience everywhere.

A broad negligence theory is not a substitute for analysing the bank’s actual mandate. In Philipp v Barclays Bank UK PLC [2023] UKSC 25, the UK Supreme Court held that the Quincecare duty does not require a bank to stop a clear payment instruction given personally by the customer. A later first-instance decision of the High Court of England and Wales, Arena Television Ltd v Bank of Scotland Plc [2025] EWHC 3036 (Comm), treated the ordinary scope of that duty as protecting against unauthorised payments and struck out claims for wider losses from continuation of a fraud. The latter is not appellate precedent, and neither case decides whether an AML restriction or statutory freeze is lawful. These payment-instruction cases should not be treated as authority for challenging an AML review or statutory freezing order.

Practical questions

Is a frozen account proof that I have been charged with a crime?

No. A bank can restrict activity during a compliance review and certain civil or criminal measures may arise without a criminal charge. The document and statutory threshold are decisive.

Can a company keep paying employees from another account?

Not automatically. First establish the scope of each order and any sanctions restrictions; a transaction that avoids an operative prohibition may be unlawful. Ask for a permitted-expenses exception or licensing review where the applicable regime allows it.

Can a co-owner or third party intervene?

Sometimes. Ownership of the funds, the account mandate, the precise order and national standing rules matter. A third party should preserve documents proving its beneficial interest rather than assume the named account holder owns every credit.

Does hiring a lawyer force the bank to disclose its suspicious-activity report?

No. Legal representation does not remove lawful confidentiality or anti-tipping-off limits. Counsel can ask for information the bank may lawfully give and use the correct court or complaint procedure if an independent legal basis exists.

Primary legal and regulatory sources

For a preliminary assessment, send the country, bank, date and exact wording of the restriction, and any urgent essential expenses—without passwords or unrestricted login credentials. Request a case review. This is general information, not advice about a particular order or jurisdiction.
