Extradition by country

Extradition Lawyer in Almaty: Local Courts and Procedure

In Almaty, the court that authorises custody and the authority that decides extradition are different. For an extradition-arrest motion, Article 589(1) identifies the district or equivalent court at the place of custody. Article 588(1) identifies a district or equivalent court for temporary detention but does not itself state the territorial venue. The Prosecutor General of Kazakhstan or a deputy decides whether to extradite. A custody order is challenged through the Almaty City Court, but a final extradition decision must be appealed to the Supreme Court within ten days after the person receives its copy.

First establish the exact detention facility, the court named in the custody papers, and the procedural stage. An arrest at Almaty International Airport does not by itself identify the court or start the deadline for appealing the final extradition decision.

Who decides what in Almaty?

The brief label “Almaty city courts” needs qualification. Chapter 60 of Kazakhstan’s Criminal Procedure Code (CPC) separates the local custody stage from the national extradition decision. Do not guess the local court from a directory. Article 589 points to the district or equivalent court at the place of custody, so confirm the venue from the prosecutor’s filing and the custody record.

InstitutionRole and practical consequence
District or equivalent court named in the prosecutor’s filingFor an extradition-arrest motion, Article 589(1) expressly specifies the district or equivalent court at the place of custody. Article 588(1) names a district or equivalent court for temporary detention but does not itself state the territorial criterion; check the prosecutor’s filing and applicable venue rule.
Almaty City CourtReviews an investigating judge’s custody order under Articles 589(5) and 107. The complaint is routed through the court that made the order; the Article 107 decision is final.
Prosecutor General or deputyMakes the final decision to grant or refuse extradition under Article 591. The Almaty City Prosecutor’s Office is not the national final decision-maker.
Supreme Court of KazakhstanReviews a complaint against the final extradition decision under Article 592. The deadline is ten days after receipt of the decision copy.

Where is the first application filed, and what happens within 72 hours?

Article 589 directs the prosecutor to apply to the district or equivalent court at the place where the person is held. Article 588(1) also refers to a district or equivalent court for temporary detention, but it does not itself state the territorial criterion. Obtain the prosecutor’s filing and verify the venue basis rather than infer it from the airport. A person arrested at the airport may be taken to a police temporary detention facility and later moved elsewhere; confirm the actual facility from the custody record. Ask for the detention record, the institution’s full name, the court name and case number; do not infer venue from the airport or the family’s address.

The first 72 hours below are a practical action plan. The 72-hour period itself is statutory under Article 587: authorities must establish identity and citizenship and seek core information from the foreign search initiator, and the person must be brought before an investigating judge to consider temporary custody or extradition arrest. Under Article 588, the prosecutor’s motion for temporary detention must be filed at least 12 hours before that period expires.

TriggerRule and immediate action
Actual detentionRecord the exact time and location. Request the detention protocol, legal basis, lawyer, interpreter and notification of family.
Within 72 hoursConfirm that identity and citizenship are being established and the person has been brought before an investigating judge. Obtain the motion and its attachments.
Temporary detention motionThe motion is due at least 12 hours before the 72-hour period ends. Prepare focused points on identity, citizenship, treaty terms and any known obstacle to extradition.
Formal request arrivesThe prosecutor may seek extradition arrest under Article 589. This is a separate custody order, not the final extradition decision.

Article 587 provides for immediate release if the person is not brought before an investigating judge within 72 hours or a circumstance excluding extradition is established. However, a custody order or prosecutor’s appeal does not always mean release: Articles 588 and 589 permit custody to continue during review in specified circumstances.

Which Almaty locations can help verify custody?

Official sources identify several distinct Almaty locations. Their existence does not prove that a particular detainee is held there; confirm the actual facility from the custody record before arranging a visit or directing a filing.

LocationVerified local factWhy it matters
Police temporary detention facility (IVS), Masanchi Street 57AA 2023 official Almaty government document listed a Police Department IVS at this address in Almaly District. It is not a live custody register, so confirm the current location before travelling.May help locate a person soon after a police arrest; confirm whether they remain there or have been transferred.
Institution No. 72The Almaty city asset-management page lists Institution No. 72 at Krasnogorskaya Street 73. It does not establish that the institution is a pre-trial detention centre or the current destination for a person detained on an extradition request.Do not treat this listing as confirmation of custody; use the actual custody record and obtain current official confirmation before visiting or sending documents.
Almaty International AirportThe official Kazakhstan government directory lists it at 2/1 B. Mailin Street. If arrest began at the airport, give counsel flight details and the exact time, then establish where the person is now.

The official page of the Almaty City Prosecutor’s Office lists its address as 7 Yu. Pomerantsev Street and provides public contact channels. The office can be a local point for identifying the responsible prosecutor or raising a procedural concern, but the actual file owner should be confirmed from the papers. The final extradition decision remains with the Prosecutor General or a deputy.

How long can detention last?

Article 588(1) allows temporary detention for 40 days from arrest or for another period set by an applicable international treaty. However, Article 588(8) still lists release triggers by reference to 40 days. The Code does not clearly reconcile those provisions. Do not assume either that a treaty term automatically displaces the 40-day triggers or that release is automatic where a treaty sets a different period. Counsel must urgently check the exact treaty, the written court order and any controlling interpretation. A later request may permit a new application under the Code.

Extradition arrest under Article 589 is a separate judicial measure once the formal request has arrived; it is not the same as Article 588 temporary detention or the Prosecutor General’s final decision under Article 591. The nationwide rules on maximum duration and extensions belong in the Kazakhstan-wide guide. Article 589-1 also matters locally: except in cases involving particularly serious crimes, and subject to the exception in Article 148(9), the investigating judge must set a bail amount sufficient to secure the person’s procedural obligations when ordering temporary detention or extradition arrest. This is not automatic release; check the order’s conditions, payment and duties.

Which appeal goes to which court?

Decision challengedRoute and deadlineEffect
Investigating judge’s custody orderUnder Articles 589(5) and 107, appeal within three days from pronouncement, through the issuing court, to the regional or equivalent court — for Almaty, the Almaty City Court. The review decision is final. The Constitutional Court’s Resolution No. 25-NP of 17 August 2023 upheld the finality rule. A custody appeal does not necessarily suspend the measure.
Prosecutor General’s final extradition decisionUnder Article 592, the person or defence lawyer appeals to the Supreme Court within ten days after receiving a copy. The detention facility must forward the complaint within 24 hours; the Prosecutor General’s office sends supporting materials within ten days of notice. A Supreme Court judge reviews the decision within one month of receiving the complaint, although the Code permits an extension in exceptional cases. Separately, if the Supreme Court suspends the extradition decision while considering an issue material to the decision, Article 592(7) provides for custody to be extended at the same time by at least one month.

Do not file the Article 592 challenge in the Almaty City Court. Under Article 591(4), a timely appeal against the final extradition decision prevents transfer until the Supreme Court judge’s ruling enters into force. The Supreme Court can cancel an unlawful or unsubstantiated decision, dismiss the complaint, or suspend extradition while a materially important issue is considered. It does not decide guilt in the foreign case.

Rights, language and the documents to prepare

Article 586 gives the person the right to know the offence stated in the request, consult a lawyer confidentially, inspect or obtain a copy of the request, participate in court consideration of custody and extradition, and express a position at the hearing. A detained foreign citizen may meet a representative of their diplomatic or consular institution. Article 30 provides for proceedings in Kazakh, official use of Russian alongside Kazakh, and free interpreter assistance for a participant who does not understand the language of proceedings. Request an interpreter immediately if needed.

  • Full name in all spellings, date of birth, citizenship, passport details and identity-document copy.
  • Exact detention time and place, detention protocol, current facility, court name and case number.
  • The custody order, prosecutor’s details, the foreign request, warrant or judgment, and dates when copies were received.
  • Any material that may affect identity, citizenship, prior proceedings, protection status or treatment risks; counsel should map it to Article 590 and the applicable treaty. Detailed refusal grounds are covered in the separate Kazakhstan guide linked above.
  • Family contact details, preferred language, consular contact and any existing lawyer appointment or power-of-attorney documents.

A Red Notice is not itself an international arrest warrant and should not be assumed to replace the formal extradition request. Keep originals safe, send copies, and make a dated log of all communications. Do not wait for the complete foreign file before seeking counsel: the three-day custody appeal and ten-day final-decision appeal run from different events.

Hypothetical Almaty example: airport arrest followed by transfer

Suppose a Georgian citizen is stopped at Almaty International Airport on information that another state seeks them. The airport is the arrest location, not necessarily the court venue. The family should record the actual detention time, obtain the custody record and confirm the current facility with the responsible authority rather than assume a particular destination, and secure the court papers, a lawyer and an interpreter. If extradition arrest is ordered, consider the three-day Article 107 appeal separately from any later ten-day Article 592 appeal to the Supreme Court. This example is hypothetical and does not predict the outcome of any case.

Which treaty applies to the requesting state?

Kazakhstan is outside the EU, so the European Arrest Warrant system does not apply. Do not assume that the 1957 European Convention on Extradition applies; check the Treaty Office’s current party list and the actual bilateral or multilateral treaty in force between Kazakhstan and the requesting state. The legal basis may instead be the Kazakhstan CPC, a bilateral treaty or a multilateral instrument in force between Kazakhstan and the requesting state. Verify treaty status rather than assuming it. The nationwide procedure is explained in the Kazakhstan extradition guide; refusal grounds and challenges are covered separately in how to stop extradition from Kazakhstan.

What the first local review should establish

A useful first status note should identify the actual facility and court; the time remaining before the 72-hour stage or the temporary-detention expiry; whether the case is at temporary detention, extradition arrest or final decision; the next deadline and correct court; and any missing request, translation, identity document or treaty confirmation. If a detail is unverified, say so and obtain the underlying record instead of guessing.

Questions families often ask

Does an arrest at Almaty Airport mean the Almaty City Court hears the first application?

Not automatically. Article 589(1) expressly directs an extradition-arrest motion to the district or equivalent court at the place of custody. Article 588(1) names a district or equivalent court for temporary detention but does not itself state the territorial criterion. Obtain the prosecutor’s filing and verify the venue basis; the airport alone does not decide it.

Can the person be released if the foreign request does not arrive?

Article 588(8) lists release triggers tied to 40 days, while Article 588(1) allows another period set by an applicable treaty. The Code does not clearly reconcile those provisions. Do not assume that a treaty term automatically overrides the 40-day triggers or that release is automatic where the treaty sets a different term; counsel must check the specific treaty, written order and any controlling interpretation.

Is an appeal to the Almaty City Court enough to stop extradition?

Not if the challenge concerns the final decision of the Prosecutor General. Article 592 requires an appeal to the Supreme Court within ten days after receipt of the decision copy. The Article 107 appeal concerns a custody order and has a different deadline and effect.
