Extradition by country

Extradition Lawyer in Astana: City Courts and Local Procedure

In Astana, the first court hearing usually concerns temporary detention or extradition arrest, not the final decision to surrender someone abroad. The Prosecutor General or a deputy decides the extradition request; an appeal against that decision goes to the Supreme Court of Kazakhstan within ten days after receipt of a copy. For an arrest at Astana International Airport, identify the responsible prosecutor and investigating judge immediately and protect the short custody-review deadlines.

Which Astana authority handles the first custody decision?

The place of detention—not the detainee’s home address or the family’s location—determines the court for the initial extradition-arrest application. Article 589 refers to a district or equivalent court and an investigating judge. Official judicial listings include the Specialized Interdistrict Investigative Court of Astana (Специализированный межрайонный следственный суд города Астаны), but the registry must confirm which court is assigned to the actual detention location. The Astana City Court is an appellate court for a detention order; it does not make the final extradition decision.

InstitutionLocal role and practical point
Astana Aviation Transport Prosecutor’s Office (Авиационная транспортная прокуратура города Астаны)The official city directory locates it at Astana International Airport, Kabanbay Batyr Avenue 119/1. For an airport arrest, ask which prosecutor handles the detention application. This office is not the final extradition decision-maker.
Astana City Prosecutor’s Office (Прокуратура города Астаны)Listed at 31 Kabanbay Batyr Avenue, it performs city-level prosecutorial and supervisory functions. Confirm which office actually has the file.
Investigating judge at a district or equivalent courtArticles 588–589 place the application before the court for the place where the person is held. Ask for the exact court, case number, hearing time and copy of the prosecutor’s application.
Astana City Court (Суд города Астаны)Hears an appeal from an Astana investigating judge’s detention order through the issuing court under Articles 589(5) and 107. This is separate from the Supreme Court appeal against the final extradition decision.
Institution No. 64, Astana criminal-execution systemThe official Astana administration lists the facility and a duty contact, +7 (7172) 57-03-12. This does not prove every extradition detainee is held there: confirm the actual place of custody before arranging a visit or sending documents.

What must happen in the first 72 hours?

This practical plan reflects the Code, not a guaranteed schedule. Within 72 hours, authorities must establish identity and nationality and request specified information from the foreign search initiator, including the alleged conduct, relevant foreign-law provision and custody decision. A Red Notice may prompt identification but does not decide extradition.

StageStatutory ruleWhat the defence should do
Immediately after detentionAuthorities seek the person’s identity and nationality, the alleged offence and foreign legal provision, the foreign custody decision and information supporting continued detention.Record the exact arrest time and legal basis; request counsel and an interpreter if needed; correct identity or nationality errors immediately.
Before the 72-hour period expiresUnder Article 588, the prosecutor must submit the temporary-detention application at least 12 hours before the 72-hour period ends. Temporary detention is normally 40 days from detention unless the applicable treaty sets another period.Obtain the application and attachments. Prepare identity documents, treaty information, medical or vulnerability evidence and material supporting a less restrictive measure.
By 72 hours after arrestThe investigating judge must consider the application immediately and no later than 72 hours after arrest. Article 587 provides for release if the person is not brought before the judge within that period or circumstances excluding extradition are established.Check the written order. If temporary detention is refused, the judge may still order custody during review on the prosecutor’s request; refusal does not always mean immediate release.

The clock starts at actual detention, not when the family learns of it. Keep a chronology of transfers, access to counsel, the prosecutor’s filing and the judge’s ruling.

What does the investigating judge decide, and where is each appeal filed?

Under Article 589, the prosecutor files for extradition arrest at the district or equivalent court where the person is held, with the certified foreign request, citizenship documents and available check materials. The judge checks identity and whether the alleged act is punishable by imprisonment—not guilt or the legality of every foreign procedural decision. Raise identity errors, missing documents and custody evidence; detailed refusal grounds belong to How to Stop Extradition from Kazakhstan.

Decision challengedDeadline and courtImportant consequence
Investigating judge’s temporary-detention or extradition-arrest orderUnder Articles 589(5) and 107, appeal within three days from announcement, through the issuing court to the regional or equivalent court. For an Astana order, the relevant appellate court is the Astana City Court.Get the written ruling and note the announcement date immediately. Article 107 allows a missed deadline to be restored for good reason, but file promptly rather than relying on restoration.
Final extradition decision by the Prosecutor General or deputyUnder Article 592, the person or defence counsel appeals to the Supreme Court within ten days of receiving a copy. The detention facility forwards the complaint within 24 hours; the Prosecutor General or deputy submits supporting materials within ten days of notification. The Supreme Court reviews compliance with Kazakh law and applicable treaties, not guilt or every foreign procedural step. Review is normally within one month after receipt, with an extension possible exceptionally. Extradition must not be carried out while the appeal awaits the Supreme Court’s final decision.

These routes have different triggers. For the national stages, see Extradition from Kazakhstan and How Extradition Works.

How long can custody last, and is bail possible?

Article 589 sets the ordinary extradition-arrest period at twelve months from detention for a person sought for prosecution. For a request to enforce a foreign sentence, custody may not exceed the sentence term imposed in the requesting state. The detention facility must notify the prosecutor at least ten days before the custody period expires.

Separately, Article 588(8) requires release from temporary detention if no extradition request arrives within 40 days, extradition arrest is not applied within that period, or circumstances excluding extradition become known. If the request arrives later, a fresh application may be possible under Article 588(9), unless the applicable treaty provides otherwise.

The twelve-month period is not, by itself, enough to decide whether release is due. Article 589 also addresses release and a possible renewed application for actual transfer, but the precise post-decision custody rule must be checked against the current consolidated text and any applicable treaty. Counsel should obtain the written custody order and verify its statutory basis before asserting either automatic release or automatic continuation.

Article 589-1 provides a bail mechanism. The prosecutor may apply to the district or equivalent court, and the investigating judge must address the bail amount when ruling on temporary detention or extradition arrest where the provision applies. The Code excludes particularly serious crimes and situations referenced in Article 148(9); bail is not automatic. Ask counsel to submit a realistic compliance plan supported by proof of address, family or care duties, work or study, medical needs and available guarantors. Bail concerns custody; it does not cancel the extradition request.

Article 589-1 concerns custody before the final extradition decision becomes legally effective. Once that decision enters into force, Article 589-1(4) says the prosecutor decides whether to apply extradition arrest under Article 589. Do not assume that an earlier bail ruling automatically governs the post-decision stage; obtain the relevant written order and check its conditions.

What should the family and foreign counsel do now?

Article 30 provides for proceedings in Kazakh, official use of Russian in court, and free interpreter and translation rights for those who do not understand the proceedings language. Under Article 586, the person may know the alleged offence, meet counsel confidentially, have counsel at interrogation, notify family, participate in hearings, obtain the request, challenge decisions and state their position. A detained foreign citizen may meet a diplomatic or consular representative.

  • Collect the detainee’s full name in all spellings, date of birth, citizenship and identity documents.
  • Record arrest time and place, police/prosecutor reference, court, case number, hearing time and copies of all orders.
  • Obtain the foreign request or notice, case number, alleged offence, foreign provisions and any sentence if enforcement is sought.
  • Give counsel the preferred language, interpreter needs, medical records and urgent medication details.
  • For bail, prepare address, family, work/study, medical and guarantor evidence, plus a feasible plan for complying with conditions.

Confirm the actual detention facility before arranging a visit or using the Institution No. 64 contact. Foreign counsel should coordinate with Kazakh counsel and verify local admission rules rather than assume a foreign lawyer may automatically appear as defence counsel.

Hypothetical airport arrest: which treaty and local route apply?

Suppose a Georgian citizen is stopped at Astana International Airport after a foreign police alert. Counsel should check the legal basis, start of the 72-hour period, timeliness of the Article 588 application and assigned investigating judge. Counsel can request the file, verify identity, seek an interpreter and raise bail under Article 589-1. The detention-order appeal runs for three days from announcement; the separate Supreme Court appeal runs for ten days from receipt of the final decision. For the legal effect of an alert, see How to Check Whether You Have an INTERPOL Red Notice; for detention before a full request arrives, see provisional arrest and provisional warrants.

Kazakhstan is not an EU Member State, so the European Arrest Warrant does not apply in Astana. The Council of Europe status chart also does not list Kazakhstan as a party to the 1957 European Convention on Extradition. Check the Code and any treaty binding both states before relying on a deadline or refusal ground. The country guide covers nationwide stages; the Almaty city page covers its local layer. Our team coordinates cross-border defence with local counsel; send a request to discuss the situation.

Questions about extradition procedure in Astana

Does an INTERPOL Red Notice itself authorise extradition?

No. It is a police cooperation alert, not a final Kazakh extradition decision. The legal basis for detention and the statutory court and prosecutorial steps must still be identified.

Does the twelve-month custody period always end in release?

No. Article 589 includes a limited extension route after an extradition decision where extra time is needed for transfer or the Supreme Court complaint. The detention record and any extension order must be checked.

Can the Astana court decide the foreign criminal case?

No. The investigating judge’s extradition-arrest review is limited by Article 589. The judge does not decide guilt abroad; the Prosecutor General or a deputy makes the final extradition decision, which the Supreme Court reviews if appealed.
