Extradition by country

Extradition Lawyer in Braga: Tribunal da Relação de Guimarães and the Local Procedure

For an international arrest involving Braga, the judicial decision is usually taken by the criminal section of Tribunal da Relação de Guimarães, not an ordinary Braga criminal court. For European arrest warrants (EAWs) and third-country extradition, territorial jurisdiction must still be checked against domicile, location and the particular procedure. Obtain the warrant, custody order and court reference immediately: the first judicial hearing must normally occur within 48 hours of arrest.

Why does a Braga arrest lead to a court in Guimarães?

The Guimarães Court of Appeal covers Braga, Bragança, Viana do Castelo and Vila Real. For EAW execution, article 15 of Law 65/2003 prioritises the person's domicile; absent a domicile, the place where the person was located when the warrant was issued applies. For ordinary extradition, article 49 of Law 144/99 uses residence or presence when the request was made. Arrest in Braga therefore does not by itself establish jurisdiction.

Do not file an EAW objection automatically with the Juízo Central Criminal de Braga at Praça da Justiça: it is an ordinary trial court. Confirm the actual file number and contact the Guimarães appeal-court defence team. A first-instance judge's exceptional emergency detention review is not a transfer of final surrender jurisdiction.

The practical distinction is particularly important when a family member calls from abroad. The person may have been arrested in Braga but live in another Portuguese judicial area. Counsel should compare the warrant-issue date, Portuguese address records and the date of the international request before naming the competent court. Ask the police which prosecutor received notification; an enquiry to the Braga criminal registry alone may miss the urgent appeal-court file.

Which local institution should the lawyer or family contact?

Guimarães publishes 14:30 on working days for ordinary electronic distribution of criminal cases, with extraordinary distribution for urgent cases. This is an administrative case-allocation time, not a hearing schedule or exception to the 48-hour rule. Confirm the assigned registry with counsel. By contrast, the Braga ordinary criminal courts list 09:30 for routine allocation; the Guimarães criminal section lists 14:30. Neither administrative time is an appointment or a substitute for the urgent statutory hearing.

The first 72 hours: a practical action plan, not a 72-hour statutory deadline

WhenWhat the law or local workflow establishesUseful action now
Immediately after detentionArresting officers must inform the public prosecutor attached to the competent court of appeal without delay (Law 65/2003, art. 18; Law 144/99, art. 53).Record arrest time and place, the police unit, country requesting surrender, and whether the document is an EAW, a provisional extradition request or merely a notice.
Within 48 hours of arrestFor an EAW, the judge-rapporteur must hear the detainee within 48 hours of arrest (Law 65/2003, art. 18(3)). In ordinary extradition, presentation to the prosecutor is due within 48 hours (Law 144/99, art. 53(2)); in provisional extradition detention, presentation to the prosecutor for a judicial hearing and custody decision is required within 48 hours (art. 62(2)). Do not confuse these distinct acts.Request counsel, a Portuguese interpreter if necessary, and the decision on detention. Ask exactly which court is scheduled to hear the detainee.
After the first hearingAn EAW objection and its evidence normally belong at the hearing, subject to a defence request for a court-fixed preparation period (Law 65/2003, art. 21(4)). Under ordinary judicial extradition, written opposition has a separate eight-day period following the hearing (Law 144/99, art. 55).Have counsel identify the correct procedural track before calculating any deadline; gather identity, domicile and relevant official records.

If the appeal court cannot hear the detainee, articles 19 of Law 65/2003 and 53(5)–(6) of Law 144/99 allow a limited detention hearing before a first-instance judge at the seat of the competent appeal court; the person is then to be presented to the appeal court on the next working day. The final EAW decision remains with the competent Relação.

How can the family locate a detainee and arrange a lawful visit?

DGRSP states that Estabelecimento Prisional de Braga primarily receives remand prisoners linked to courts in Amares, Braga, Póvoa de Lanhoso, Vieira do Minho and Vila Verde. This does not confirm any particular EAW detainee's location: another institution or transfer is possible. Ask counsel to verify placement.

Braga prison publishes family visiting times on Tuesday, Thursday, Saturday and Sunday, 09:00–11:30 and 14:30–16:50. Confirm the person's location, identification, registration and restrictions before travel. These slots do not govern confidential lawyer consultations.

A telephone number for the prison identifies a possible contact point, not a right for an unverified caller to obtain custody details. If a detainee cannot be located, relay identifying details through the appointed defender, and distinguish police custody immediately after arrest from remand placement ordered by a court. Before passing health information to an institution, ask counsel which secure channel and authorisation are appropriate.

Braga cases show why the warrant type and the actual ruling matter

On 2 July 2026, Polícia Judiciária reported a Braga arrest under a Belgian EAW for sentence enforcement. The person appeared before Guimarães Relação, which ordered pre-trial detention. This shows an actual local route, not a predetermined outcome for others.

On 9 June 2026, Guimarães case 128/26.7YRGMR refused a Spanish EAW concerning breach of a Spanish precautionary measure: that conduct was not criminal in Portugal and was outside categories exempt from dual-criminality review. Missing photographs or minor inaccuracies did not automatically invalidate the warrant; additional information may cure defects. The ruling is fact-specific.

On 6 November 2025, in 2083/25.1YRLSB.G1.S1, the Supreme Court set aside Guimarães' refusal to surrender a person and recognition of a German sentence for execution in Portugal. Article 12(1)(g) required the prosecutor's legally prescribed initiative and foreign-judgment documents. An address, job or family in Braga cannot replace that procedure.

A later Supreme Court decision, 11 February 2026, 3784/25.0YRLSB.S1, required proof of lawful residence, stable social and family ties and concrete reintegration benefit, not mere assertion of residence. That case originated in Lisbon, not Braga; ordinary chamber judgments should not be described as automatically binding formal precedents.

These rulings illustrate two distinct questions at Guimarães: whether the foreign conduct falls within the EAW offence categories and, for a sentence warrant, whether the formal national-execution mechanism has lawfully been activated. Neither issue can be resolved simply by disputing the underlying prosecution or demonstrating residence. Counsel should first identify the purpose of the warrant and the governing article; a different offence or procedural stage can change the outcome.

What changes if the request is from outside the European Union?

The EAW under Law 65/2003 operates between EU member states. Requests from the United States, Switzerland or Turkey follow the applicable treaty and Law 144/99, with a Prosecutor General/Justice Minister administrative stage before judicial examination. The 1957 European Convention on Extradition entered into force for Portugal on 25 April 1990, with reservations; check the specific requesting country's instruments. UK surrender now follows a separate EU–UK arrangement.

For EAWs, consent under article 20 is irrevocable and replaces the contested process; a waiver of speciality is a separate choice. In ordinary extradition, article 54 requires the judge to explain opposition, consent and speciality. Seek defence advice and interpretation before either declaration.

Which appeal is filed at which court?

For EAWs, Law 65/2003 article 24 permits appeal against specified detention decisions or the final ruling to the criminal sections of Supremo Tribunal de Justiça within five days from notice, or from pronouncement of an oral recorded decision. For ordinary extradition, Law 144/99 articles 49 and 58 allow 10 days to appeal the final decision to the Supreme Court; appeal of an extradition grant suspends it. These are not the same as detention review or a constitutional challenge.

EAW detention limits under Law 65/2003 article 30 differ from extradition custody rules under Law 144/99 articles 38, 52, 63 and 64. Calculate from arrest, provisional custody, formal request and appeals. Detailed refusal grounds belong in the Portugal challenges guide; the national steps in the Portugal extradition overview.

A hypothetical call from Braga, and the documents to send

Hypothetical: A Spanish national domiciled in Braga is arrested on a Belgian EAW. The family first calls the Braga trial court. Counsel checks the article 15 domicile rule, identifies the Guimarães file and obtains the arrest record for the 48-hour hearing. Neither domicile nor refusal of consent guarantees release or non-execution.

Give Portuguese counsel: (1) warrant and translations; (2) passport and dated residence records; (3) arrest time and report; (4) case number and custody order; (5) relevant medical records; and (6) secure contact details. Specify whether the person is sought for prosecution or sentence enforcement; different foreign records may be needed.

Short questions families ask

Is the Guimarães court a Braga branch?

No. It is a separate court of appeal in Guimarães serving the judicial district that includes Braga.

Can a family member just turn up at Braga prison?

Check the person's location and the prison's current admission requirements first. Published family visiting hours do not establish that the person is held there.

Does a Red Notice itself mean extradition has already been ordered?

No. Ask counsel to identify the actual Portuguese detention basis and any formal judicial or extradition request; a police alert and a surrender decision are different acts.

For coordination with Portuguese local counsel, documents can be submitted through the confidential enquiry form. This is general information, not a prediction of any case.
