Extradition by country

Extradition Lawyer in Chisinau: Chișinău courts and the Local Procedure

In Chișinău, a foreign extradition request is put before an investigative judge of Judecătoria Chișinău, in practice at its Ciocana venue; an appeal goes to Curtea de Apel Centru. The judge decides whether the legal conditions for extradition are met, not whether the person is guilty in the foreign case. For an arrested person the hearing is urgent, and the ordinary challenge to an extradition ruling has a 10-day period from pronouncement under article 544 of Moldova’s Criminal Procedure Code (CPC).

Where the motion is heard: Ciocana, not the criminal-trial venue

Article 544(6)–(7) sends the request presented by the Prosecutor General or Minister of Justice to the district court in whose territorial area the Ministry sits. The Ministry is in Chișinău, at strada 31 August 1989, 82. The court is Judecătoria Chișinău, and its sediul Ciocana has been assigned investigative-judge business since January 2022. It is at strada Mihai Sadoveanu, 24/1. The Buiucani venue deals with criminal trials; it should not be treated as the automatic first address for an extradition motion. Court allocation and hearing notices must nevertheless be checked against the live docket before anyone travels.

There is a consequential local distinction: the request may concern an arrest anywhere in Moldova, but the statutory seat-of-Ministry rule channels the extradition motion to the Chișinău court. The relevant lawyer therefore needs both the arrest paperwork from the arresting unit and the case material filed at Ciocana. Assuming that the criminal court nearest the airport, prison or family home owns the extradition hearing may waste a critical day.

Airport detention and the first 72 hours

At Chișinău International Airport, the Sectorul Poliției de Frontieră „Aeroportul Internațional Chișinău” is the designated border-police unit; its published location is bulevardul Dacia 80/3. A border stop does not itself prove that a court has ordered extradition. Ask whether there is a foreign judicial arrest warrant, an extradition-related detention record, a separate Moldovan criminal case, or an immigration measure. They engage different legal tracks. Article 171¹ CPC requires immediate notification of the Prosecutor General’s Office or, where relevant, the Ministry of Justice upon detention for extradition.

The following is a practical action schedule, not a promise that every case receives a hearing within exactly three days. Article 11 CPC sets a general ceiling of 72 hours for detention before a judicial arrest order; article 171¹ directs extradition detention to the relevant Code procedures. Counsel must establish the precise recorded time of restraint and any subsequent judicial order.

Article 547 CPC permits urgent arrest before the formal extradition request, initially for 18 days, potentially extended to no more than 40 days from arrest on the applicable request. These are not the same as the first detention hours, the ordinary time for the final extradition ruling or a licence to detain indefinitely. A delayed foreign request should be checked against the actual court order and the applicable treaty.

Where is the detained person, and how does counsel gain access?

Penitenciarul nr. 13 Chișinău is a real detention institution; the national penitentiary administration identifies rooms there for meetings with lawyers. That does not establish that every person arrested at the airport is placed there. A short police detention, transfer to another holding centre and remand in a prison are separate steps. The family should establish the current location from the detention record or counsel rather than arriving at Penitentiary 13 on an assumption.

Article 547(1) CPC sets a 12-month upper limit for preventive detention for extradition from detention until handover. This outer limit does not automatically authorise twelve months in a particular case. Article 547(2)–(3) also addresses replacement of arrest when health is medically incompatible with detention or when stable residence of the person and family in Moldova and absence of absconding grounds are established. A lawyer should seek the court or prosecutor's decision on the specific preventive measure, not confuse it with the final extradition decision.

Finding a defence lawyer, an interpreter and the real file

Article 544(7) CPC requires the prosecutor, person and chosen or state-appointed defender to participate in the extradition-motion hearing; a Ministry representative joins for convicted-person requests. The Oficiul Teritorial Chișinău of the National Council for State-Guaranteed Legal Aid is at Alecu Russo 1, block 1A, third floor. Its published contacts are a way to find the appropriate publicly funded scheme when privately retained counsel has not yet been organised; do not assume eligibility has already been confirmed.

The territorial legal-aid office publishes application and consultation hours Monday to Friday, 10:00–16:00, with a 12:00–12:30 break, and the email ot_chisinau@cnajgs.md. These are office contact hours, not a limit on asking the arresting authority or counsel for immediate legal assistance.

Ask for an interpreter into a language the person actually understands and have counsel inspect the foreign charge, arrest warrant, translation, nationality documents and the detention grounds. Moldova's declaration under article 23 of the European Convention on Extradition addresses the language of incoming request papers; it does not eliminate the individual's right to understand the Moldovan hearing. For a relative abroad, a clear signed authority to share documents can help counsel communicate lawfully, but it should not be presented as a condition for emergency legal representation.

What the Ciocana judge decides, and what must be raised there

The court examines extradition conditions and objections within its legal jurisdiction. It does not retry the underlying foreign criminal accusation. The defence should put identity errors, citizenship or protection status, document discrepancies and substantiated risks before the competent authority with supporting records. Under article 171¹(4), detention for extradition must end once Moldovan nationality or the specified protection status is established, unless another lawful basis justifies detention. A Moldovan passport or a refugee determination should be delivered to counsel immediately.

Consent to a simplified extradition under article 545 is not a casual administrative signature: an investigative judge explains the consequences and confirms consent with counsel present. A separate express waiver of the rule of speciality concerns prosecution for other offences after surrender. Confirmed consent cannot subsequently be withdrawn under that article. Do not conflate this choice with an ordinary decision not to contest a particular detention measure.

For full treatment of legal bases and treaty routes, use the Moldova country guide; for detailed grounds of refusal and procedural remedies, see the separate Moldova remedies page. Moldova is party to the 1957 European Convention on Extradition, including declarations and reservations relevant to nationals and the documentation language. Moldova is not an EU member: an EU European Arrest Warrant is not the local surrender mechanism. For any requesting country, counsel must establish the applicable instrument rather than assume that the same treaty rules apply to every request.

Appeal court and the 2026 decisions that matter here

Article 544(9) gives a 10-day recurs deadline counted from the court's pronouncement, not from the family's discovery of the ruling. The first-instance ruling is to be written within 24 hours after pronouncement. The appeal is heard by Curtea de Apel Centru, at Teilor 4. Legislative texts sometimes retain the former name “Curtea de Apel Chișinău”, but the Superior Council of Magistracy confirms that the new name has applied since 27 December 2024. Counsel should identify the correct procedural channel and obtain the operative ruling at once.

Two directly relevant Constitutional Court decisions arose from extradition litigation in this exact court chain. Decision no. 60 of 2 April 2026 (Kydenko; file 7r-7/2025 at Curtea de Apel Centru) declared inadmissible a constitutional challenge concerning which prosecutors may appeal under article 544(9). It did not invalidate the prosecutor's right to bring a recurs; the Court explained that reconciling overlapping ordinary statutes belongs to the ordinary courts. A defence cannot safely assume a prosecution appeal fails simply because an officer other than the Prosecutor General signed it.

Decision no. 87 of 21 May 2026 arose from a Ciocana extradition order in the Goujon matter, appealed to Curtea de Apel Centru. It rejected as inadmissible a constitutional challenge to the wording about sufficient assurances for an absentia conviction. The Court described an individual assessment of whether assurances are credible and prevent a real risk of a flagrant denial of justice. It did not decide that assurances always suffice or finally resolve that person's extradition appeal. For a comparable case, counsel needs the actual foreign retrial guarantee and the record in the current case, rather than an abstract attack on wording already considered by the constitutional court.

These Constitutional Court rulings are nationally authoritative on their constitutional questions, but neither is a new merits judgment deciding every extradition defence. The ordinary reviewing court for the Chișinău first-instance ruling remains Curtea de Apel Centru. Counsel should check later rulings in that court's own file and subsequent higher decisions before treating any earlier result as settled.

A separate route was restricted by the Supreme Court of Justice on 26 March 2026 in extradition proceedings originating at Ciocana (case 1cs-52/26). The Court rejected a request to transfer the case to another court: dissatisfaction with the handling of hearings or a suspicion about an individual judge is not, without more, a basis to disqualify the entire court. An individual judge may be challenged through recusal; transfer on that ground becomes relevant only if recusal has been allowed and the court cannot form a bench. The Supreme Court, rather than the ordinary extradition appeal court, decides transfer requests under CPC article 39(5). That order did not decide the separate asylum dispute or the merits of extradition.

One example and a checklist for relatives abroad

Hypothetical example: a Georgian traveller is stopped by the Chișinău airport border-police sector after another state seeks his arrest. His sister hears he has been taken to a detention facility but does not know which one. She obtains his full name, birthdate, time of the airport stop and the issuing authority on the detention paper, then asks a Chișinău lawyer to locate the custody order and any Ciocana court listing. This is preferable to guessing from a Red Notice that surrender has already been ordered: a notice and the Moldovan extradition ruling are different instruments.

  • Send counsel a clear copy of the passport, any second citizenship evidence and documents establishing residence or family ties in Moldova.
  • Record the arrest time precisely; distinguish the police record, judicial custody order and extradition ruling.
  • Provide the foreign case number, charge, warrant, conviction and translations already available, without editing them.
  • Supply relevant medical records, protection decisions, and the contact of any lawyer in the requesting state.
  • Ask for the Ciocana docket number, hearing notice, chosen or appointed defender, and the name of the current detention institution.
  • If a ruling has been pronounced, urgently ask counsel to calculate the 10-day recurs period from that date.

Questions specific to a Chișinău extradition case

Does an arrest at the airport mean I will be extradited?

No. The border encounter, judicial custody decision and final extradition ruling are distinct acts requiring separate verification.

Is Curtea de Apel Chișinău a different appellate court?

It is the former name of Curtea de Apel Centru following the judicial reform effective in December 2024.

May relatives attend or inspect the case without the lawyer?

Public access and access to confidential file material are different matters. Ask the registry for hearing information and let counsel request protected case records.
