Extradition Lawyer in Johannesburg: Johannesburg and the Local Procedure
For an extradition arrest in Johannesburg, the first local step is an inquiry before a magistrate for the area where the arrest occurred; the magistrate does not make the final surrender decision. For section 10, the Minister decides surrender after committal; section 12 follows a different route. OR Tambo International Airport is mapped to Kempton Park Magistrate Court, not Johannesburg Main Seat. If a magistrate commits someone for extradition, the statutory appeal period is 15 days from the date the order is issued.
Which magistrate has jurisdiction in Johannesburg?
Section 9(1) of the Extradition Act 67 of 1962 requires a person detained under an extradition warrant to be brought “as soon as possible” before a magistrate in the arrest area. The Act sets no fixed hours for an extradition inquiry; a general “48-hour rule” does not supply the timetable. Check the warrant, custody circumstances and any separate domestic charge.
Johannesburg is not one undivided court district. The Department of Justice’s Gauteng map distinguishes Johannesburg Main Seat from sub-districts Alexandra, Booysens, Lenasia, Randburg, Roodepoort and Soweto. Brixton, Hillbrow, Jeppe and Newlands are listed as places of sitting associated with Johannesburg Main Seat.
| Institution or place | Local role and verified details |
|---|---|
| Johannesburg Magistrates’ Court | For arrests within the relevant Main Seat area; confirm the actual district and case listing. 26 Fox Street, corner Fox and Ntembi Piliso Streets, Johannesburg 2000; 011 491 5000. |
| Brixton, Hillbrow, Jeppe and Newlands | Officially listed places of sitting associated with Johannesburg Main Seat. Confirm whether the extradition file is allocated there. |
| Kempton Park Magistrate Court | The official map assigns OR Tambo International Airport to Ekurhuleni, Kempton Park Sub District and this court. Address: 17 Monument Road, Kempton Park 1620; 011 395 6300. |
| Gauteng Local Division of the High Court, Johannesburg | Current local superior-court name. The Judiciary states that this division has concurrent jurisdiction with Gauteng Division, Pretoria over the whole province; confirm the filing route for the actual case. |
Hypothetical example: if a traveller is arrested at OR Tambo, the family should first ask whether the file is with Kempton Park Magistrate Court. If the arrest occurs later in a Johannesburg suburb, the correct court may differ because the magisterial sub-districts are separate. Do not rely only on the informal label “Johannesburg”.
Who prosecutes the inquiry, and who decides surrender?
Section 17(1) of the Extradition Act allows a public prosecutor to appear at an extradition inquiry. The prosecutor assigned to a particular file should be confirmed from the case number and court record; do not assume that a named senior official personally handles it. In a section 10 case, the magistrate decides the judicial stage and the Minister decides surrender under section 11; section 12 follows a different statutory route.
Under sections 9 and 10, the magistrate decides whether the person is liable to be surrendered and, for a person accused rather than convicted, whether the statutory evidential threshold is met. A section 10 committal order is not the final Ministerial surrender decision and is not a finding of guilt at the foreign criminal trial. For nationwide treaty rules and refusal grounds, see the South Africa extradition guide.
What should be checked about the arrest warrant?
The published Act still displays section 5(1)(a), but the Constitutional Court in Smit v Minister of Justice and Correctional Services [2020] ZACC 29 declared it unconstitutional and invalid from 18 December 2020. A warrant cannot be issued merely because the Minister notified a magistrate that a request had arrived; that route lacked independent judicial oversight. Section 5(1)(b), which requires information about the alleged extraditable offence and the magistrate’s own assessment, is materially different.
In Britton v Minister of Justice and Correctional Services [2024] ZASCA 148, the Supreme Court of Appeal held that Smit operated prospectively and did not retrospectively invalidate a warrant issued before 18 December 2020. That does not validate a new post-Smit warrant based on section 5(1)(a). Compare the warrant’s date and legal basis with the information placed before the magistrate; the old wording in the consolidated Act does not prove validity.
What happens at the first appearance?
Under section 9(2), the magistrate has powers similar to those at a preparatory examination, including remand and bail. Section 9(3) allows foreign depositions, conviction records, warrants and translations if authentication or treaty rules are met. Under section 10(2), a prosecution-authority certificate that sufficient evidence exists is conclusive proof of that point.
Section 9 sets no universal 24-, 48- or 72-hour timetable. This first-72-hours plan is practical, not statutory:
| Practical stage | Action and local check |
|---|---|
| Immediately after arrest | Ask for the warrant, case number and actual place of custody. Record the exact arrest location and check whether it falls within Johannesburg Main Seat, another sub-district or Kempton Park. |
| Before the inquiry | Give counsel identity documents, the warrant, papers received and details of any South African proceedings. Check territorial jurisdiction and whether foreign documents need authentication or translation. |
| At first appearance | Ask for the next date, bail position and copies of orders. Record each order’s date; appeal time runs from the order. |
Where may the person be held, and how can family help?
Do not guess the detention facility from the city name. The official materials reviewed do not establish one fixed centre for all Johannesburg extradition detainees. Confirm the person’s actual location with the custody authority, court record or Correctional Services before travelling.
Section 35(2)(b) of the Constitution gives a detained person the right to choose and consult a legal practitioner. If the person does not understand the court language, request an interpreter immediately; foreign papers are not automatically translated. If consular assistance is wanted, ask the custody authority to arrange contact.
- Save the warrant, police papers, court dates, remand orders and every bail decision; request copies if necessary.
- Prepare a short chronology of the arrest, arrival and residence in South Africa, earlier extradition proceedings and any pending South African criminal case.
- Collect reliable documents about identity, health, family responsibilities, residence and proposed bail arrangements. Counsel can decide what is relevant and how it should be filed.
- Send documents securely to counsel rather than discussing disputed facts in open messages that may later be disclosed.
What if the magistrate orders committal?
Section 13(1) allows an appeal against an order under section 10 or 12 within 15 days after the order is issued. The Act says “days”, not “working days”; calculate from the order immediately, including any court-rule or holiday issue. Section 14 restricts surrender before the appeal period expires, unless the right of appeal is waived in writing, and before a filed appeal is disposed of. Do not sign a waiver or consent to a simplified process without advice.
The Gauteng Local Division, Johannesburg and Gauteng Division, Pretoria have concurrent jurisdiction across Gauteng, but confirm the forum from the originating record and type of decision. Section 13 still refers to the “Supreme Court”. An appeal against committal differs from review of the Minister’s section 11 decision; neither is simply habeas corpus or a constitutional application.
Bail after committal is time-sensitive. In Wares v Additional Magistrate, Simonstown (CCT 258/24, 23 December 2025), the Constitutional Court held section 10(1) invalid insofar as it excluded bail after committal while the Minister’s decision or review proceedings were pending. The declaration was suspended for 24 months, but an interim section 10(5) was read in. On application, the committal magistrate may grant or extend bail if the interests of justice permit, pending the Minister’s decision or legal proceedings to review the magistrate’s or Minister’s decision; the magistrate sets the deposit. Section 13(3) separately covers bail after an appeal is lodged, and release is not automatic. Parliament’s current status page lists the Extradition Bill B14-2026 as “Sent for Assent”. That status alone does not show that it has become law or commenced. Before relying on the interim wording, check for presidential assent, Gazette publication and the commencement date.
Which treaty and refusal issues belong in the wider case?
South Africa is not an EU Member State, so the European Arrest Warrant does not govern an arrest in Johannesburg. The basis depends on the requesting state and the route under sections 2–3 of the Extradition Act. Counsel should identify the instrument and confirm that it applies. The country-wide treaty analysis and statutory refusal grounds belong in the South Africa extradition guide and How to Stop Extradition from South Africa; this page focuses on local court routing and records.
What should you send before contacting a lawyer?
Send the arrest location and time, court and case number, warrant and papers received, requesting country, whether the person is accused or convicted, and every order with its date. Ask counsel to identify the next deadline, warrant basis, treaty and urgent forum. A Red Notice is not itself an arrest warrant; the distinction from immigration removal is explained in Extradition vs Deportation.
The site team coordinates cross-border defence with local counsel; use the contact request page to request coordination. This information is general and does not replace advice on the actual warrant, court record and current legislation.
Questions families often ask
Is the first extradition hearing always at Johannesburg Magistrates’ Court?
No. Section 9 points to the magistrate for the area where the person was arrested. The official map assigns OR Tambo International Airport to Kempton Park Magistrate Court and distinguishes several Johannesburg sub-districts.
Does a committal order mean the person will definitely be surrendered?
No. The magistrate’s order and the Minister’s later section 11 decision are separate stages. An appeal or review may be available, but the deadline and forum must be checked immediately.
Can bail be requested after committal?
Potentially. Section 13(3) covers bail applications after an appeal is lodged, and Wares read an interim section 10(5) into the Act for bail pending the Minister’s decision or review proceedings. Check whether remedial legislation has changed the position.
