Extradition Lawyer in Palermo: Corte d'appello di Palermo and the Local Procedure

If a foreign state seeks surrender of a person connected with Palermo, the local judicial stage may be handled by the Corte d’appello di Palermo (Palermo Court of Appeal), with the Procura Generale (General Prosecutor’s Office) supporting international-cooperation work. In ordinary extradition, Article 717 of the Italian Code of Criminal Procedure sets a five-day limit for the initial custody interview; the later merits hearing has separate deadlines. First establish whether the papers concern extradition or a European Arrest Warrant (EAW), and which court became competent under the statutory criteria.

This page covers Palermo’s institutions and practical access routes. The national procedure and detailed refusal grounds belong to the Italy extradition guide and Italy refusal and appeal guide.

Which Palermo offices handle international surrender cases?

The Court of Appeal decides the judicial question when ordinary extradition requires a court decision. The General Prosecutor’s Office supports the Procuratore Generale on international criminal cooperation, including extradition and EAW matters; it does not replace the court or the Ministry of Justice.

Palermo Pagliarelli — Casa circondariale “Antonio Lorusso”Ministry-listed remand institution at Piazza Pietro Cerulli 1. Its record says it receives new arrivals from liberty; it does not establish that all extradition detainees are placed there.
Palermo Ucciardone — Casa di reclusione “Calogero Di Bona”A separate prison for serving sentences, at Via Enrico Albanese 3. Do not assume it is the destination for a newly arrested person.

Why the arrest history matters more than the airport name

For ordinary extradition, Article 701(4) c.p.p. uses a hierarchy: the Court of Appeal for the district where the person had residence, abode or domicile when the request reached the Minister of Justice; or the court that ordered provisional arrest under Article 715 or whose president validated police arrest under Article 716. If these criteria do not identify a court, Rome is the residual court. The official airport charter identifies Palermo Falcone Borsellino International Airport at Punta Raisi, in Cinisi, about 35 kilometres from Palermo, but the airport name alone does not decide competence.

Hypothetical: a traveller is arrested at Palermo airport and the Palermo Court of Appeal president validates the arrest under Article 716. Article 701(4) points to that court for ordinary extradition. If the request reached the Ministry before arrest and the person’s relevant residence was in another appellate district, counsel must apply the statutory priority rule instead. The EAW has a separate competence scheme.

What happens during the first five days?

Article 717’s five-day period is for identification and questioning after execution of a coercive measure or validation of arrest; it is not a deadline for the whole case. Defence counsel must be present and receive at least 24 hours’ notice. Consent to extradition and waiver of the speciality guarantee have different consequences and should not be treated as routine formalities.

StageDeadline and next action
Immediately after arrestObtain the arrest record, legal basis, warrant or notice number, issuing state and next hearing details. Ask for counsel and an interpreter if needed; do not sign consent before its consequences are explained.
Initial custody interviewArticle 717: as soon as possible and no later than five days after the measure or validation. Confirm counsel’s presence and the 24-hour notice.
Ordinary extradition merits hearingArticle 704: hearing notice at least 10 days beforehand; written submissions may be filed up to five days before the hearing.
Decision and challengeArticle 704 sets six months from the Procuratore Generale’s requisitoria for the Court of Appeal decision. A merits appeal under Article 706 and a challenge to a custody order are different routes; counsel must calendar the deadline from the actual order and service record.

These periods are a practical orientation only. Counsel must calculate any live deadline from the current applicable text and the actual order, notification and proof-of-service record.

An EAW is a separate EU surrender procedure under Framework Decision 2002/584/JHA; ordinary-extradition deadlines do not apply to it. Article 696 c.p.p. gives priority to applicable international conventions. For a request from outside the EU, counsel should identify the specific treaty and any declarations or reservations relevant to the requesting state; the Italy guide linked above covers the nationwide framework.

How to contact Palermo’s international-cooperation office

The General Prosecutor’s Office publishes a dedicated Ufficio Estradizioni e Rogatorie contact route at the old courthouse, first floor, room 30. Its email is estradizione.pg.palermo@giustizia.it, its PEC is estradizione.pg.palermo@giustiziacert.it, and public hours are listed as 08:30–13:30 on weekdays. The office describes work on extradition and EAW matters, participation in Court of Appeal hearings, submissions, opinions and appeals, and liaison with the Ministry of Justice, Interpol/SIRENE services, Eurojust and foreign judicial authorities. An email does not necessarily file a defence submission or stop a deadline: ask counsel which registry must receive the document and how receipt will be proved.

Where might a person be held, and how are lawyer visits arranged?

The Ministry publishes separate records for Pagliarelli and Ucciardone, but those records do not prove where a particular extradition detainee is held. Confirm the person’s actual location before travelling or sending documents.

FacilityPublished lawyer access
PagliarelliLawyer interviews listed 09:00–14:00 Monday through Saturday. Booking email: colloquiavvocati.cc.pagliarelli.palermo@giustizia.it.
UcciardoneLawyer interviews listed 08:00–14:00 Monday through Saturday; no public holidays. The lawyer must arrive by 13:30 for one final previously booked interview. Booking email: matricola.cr.ucciardone.palermo@giustizia.it.

If the person does not speak Italian, tell counsel their strongest language and whether they understand the orders. Article 717 contemplates an interpreter where necessary. Do not assume every document automatically requires written translation: in judgment No. 14575/2026, the Court of Cassation held on its facts that the Procuratore Generale’s requisitoria did not require written translation where the person already knew the allegations through a duly translated custody order. The published full text of No. 29019/2026 also states that an order refusing to modify custody had to be translated when the person was known not to understand Italian, including the reasons deposited later. These are different procedural acts; any real language barrier needs individual assessment.

What recent case law means for urgent custody requests

A custody challenge is separate from the final extradition decision. Article 714(3) c.p.p. prevents coercive measures where there are reasons to believe the legal conditions for a favourable extradition decision are absent. The published full text of Cassation judgment No. 29019/2026 states that the risk of torture or inhuman or degrading treatment must be considered when reviewing a request to modify an extradition custody measure, not automatically deferred to the merits stage. The case involved Russia, so its country-specific facts do not dictate the result in another case; the practical point is to provide current, objective and reliable evidence early.

The Court of Cassation hears the Article 706 challenge to an ordinary extradition merits judgment and must decide within six months of receiving it; the filing period itself follows the applicable ordinary rules. The detailed grounds and remedies are covered in the Italy refusal and appeal guide. If an EU citizen is sought by a non-EU state, immediately tell counsel about nationality and residence: depending on the facts, the CJEU’s Petruhhin line may require consultation with the Member State of nationality.

What should the family or foreign lawyer prepare?

  • Passport and identity documents, date of birth and preferred language.
  • Arrest record, custody order, EAW or international notice, formal extradition papers, and the date/time each was received.
  • Residence, family, work, study and medical evidence relevant to custody; these facts alone do not guarantee release.
  • Prior court, asylum or protection decisions and original, dated material supporting any specific risk on return.
  • The confirmed detention facility and any visit-booking reference; do not send sensitive case papers to a prison email unless counsel confirms that channel is appropriate.

Keep a chronology of the arrest, first lawyer contact, interpreter request, service of orders and next hearing. The first 72 hours are a practical action plan, not a separate statutory deadline: identify the procedure, secure counsel and interpretation, preserve documents and calendar the actual deadlines.

Frequently asked local questions

Does an arrest at Palermo Airport automatically make the Palermo Court of Appeal competent?

No. Article 701(4) uses a hierarchy based on residence, abode or domicile, or the Court of Appeal that ordered provisional arrest or validated the police arrest. The arrest location matters but is not the only criterion.

Does the five-day rule mean the entire extradition case ends in five days?

No. Article 717 sets the initial identification and interview deadline; the later hearing and decision have separate rules under Article 704.

Will the person necessarily be held at Pagliarelli or Ucciardone?

No public source reviewed establishes either facility as the compulsory placement for all extradition detainees. Confirm the actual location before arranging a visit.

Can the family stop a deadline by emailing the General Prosecutor’s Office?

Do not assume so. Ask counsel which registry must receive a procedural filing and preserve proof of receipt.

If someone has been arrested or notified of a surrender request, the cross-border team can coordinate an initial review with local counsel and help organise the records. Use the request page to make an enquiry; no outcome or release can be promised.
