Extradition Lawyer in Bari: Corte d’appello di Bari and the Local Procedure
In Bari, an extradition or European arrest warrant case is handled through the Corte d'appello di Bari (Bari Court of Appeal), with the Procura Generale presso la Corte d'appello di Bari handling the prosecution-side international cooperation. The first judicial review can occur within hours, but the clock depends on whether the arrest concerns an EU European arrest warrant or an extradition request from a non-EU country. A lawyer's immediate task is to identify that route, obtain the arrest record and check the competent judge, custody order and next hearing.
Which Bari office handles the file?
The court's official directory identifies a Cancelleria III sezione penale/estradizioni – MAE: the registry of the Third Criminal Section for extradition and the mandato d'arresto europeo (European arrest warrant, EAW). It lists sez3.penale.ca.bari@giustizia.it and a dedicated certified-mail address, mandatoarrestoeuropeo.ca.bari@giustiziacert.it. The published office telephone lines include 080 529 8117 and 080 529 8284. The court is at Piazza Enrico De Nicola, 70123 Bari. These are court contacts, not a lawyer's office; a party should not assume an informal email is an authorised procedural filing.
Opposite the judicial role of the court stands the Procura Generale della Repubblica presso la Corte d'appello di Bari, at Piazza Enrico De Nicola 1. Its published foreign judicial relations group comprises two deputy prosecutors general and covers both incoming and outgoing extradition and EAW matters. The website says the deputy prosecutor on duty initially manages urgent Schengen and EAW steps, before forwarding the file to the specialised group. Another published international affairs office handles extradition contact between the court and the Ministry of Justice's international cooperation office. Thus, on an urgent weekend arrest, asking for the on-duty procedural channel is more useful than assuming an individual named official is already assigned.
| Institution | Actual local role | Where to direct the enquiry |
|---|---|---|
| Corte d'appello di Bari, Third Criminal Section registry | Extradition / EAW court files and hearing information | Piazza Enrico De Nicola; sez3.penale.ca.bari@giustizia.it |
| Procura Generale di Bari | International judicial cooperation, urgent prosecutorial steps | Piazza Enrico De Nicola 1; ask for the international cooperation unit |
| Casa circondariale Francesco Rucci | One possible Bari custodial institution, not a guaranteed destination | Corso Alcide De Gasperi 307; check the actual custody record first |
| Border police at Bari airport or port | Possible first police contact following a border-related alert | Airport: Viale Enzo Ferrari 1; port: Corso Antonio De Tullio 1 |
Does arrest in the province always lead to Bari?
No. The Bari Court of Appeal district covers the ordinary court circuits of Bari, Foggia and Trani, not all of Puglia. The competent court depends on the instrument and the statutory route. For an EAW, Law 69/2005, Art. 5(2), ordinarily assigns the case to the appellate district where the person had residence, domicile or abode when the measure was received by the judicial authority; if police arrest under Art. 11 occurs, Art. 5(5) assigns the surrender decision to the district where the arrest occurred. For an urgent police arrest on a third-state provisional extradition request, CPP Art. 716(2) sends the record to the president of the Court of Appeal in the district of arrest. Foggia is within Bari’s district. Confirm the actual instrument and arrest record before filing; the prison’s location alone does not establish which authority currently holds the file.
The Bari Questura's directory separately lists border-police offices at Bari Palese airport and at the Port of Bari. These are concrete places where an international-alert situation may first be encountered; neither listing proves that any particular arrest was carried out there. For the family, the decisive question is which police unit drew up the record and to which judicial authority it sent that record. An alert in the Schengen Information System and an INTERPOL Red Notice are not identical legal instruments.
What happens in the first 72 hours?
The following is a practical 72-hour action plan, not a promise that every case must be resolved in 72 hours. It separates two different statutory clocks and identifies their triggering events. Preserve the time printed on the arrest record; do not calculate every deadline from the family's first telephone call.
| When / legal route | Responsible actor and rule | What counsel should check |
|---|---|---|
| Immediately: EU EAW based on a qualifying SIS alert | Police send the arrest record to the president of the competent Court of Appeal within 24 hours of arrest (Law 69/2005, Art. 11). | Exact arrest time, identification, the SIS record, notice of rights and appointment of counsel. |
| After receipt of the EAW arrest record | Court president or delegated appellate judge hears the person within 48 hours of receiving the record, with defence counsel and interpretation if needed (Art. 13). | Whether the separate 24-hour and 48-hour triggers were respected; whether release, validation and coercive-measure orders were issued. |
| Immediately: urgent non-EU extradition arrest | Police make the person available to the president of the appeal court in the district of arrest within 48 hours of arrest (Code of Criminal Procedure, Art. 716(2)). | Foreign provisional-arrest request, identity, asserted flight risk, notification to the minister. |
| Following the non-EU record transmission | The president must validate the urgent arrest, where lawful, within the subsequent 48 hours after the person and arrest record are placed at the president’s disposal (Art. 716(3)). Because police have up to 48 hours to transmit the record, the overall period can reach 96 hours from arrest; the judicial 48-hour clock starts when the person is placed at the president’s disposal. | Distinguish validation from the final extraditability decision, but raise any immediately apparent legal bar at this stage. |
An EAW person should receive comprehensible information, access to a defender and an interpreter where necessary under Law 69/2005, Art. 12. Under its Art. 10, the court must explain the possible consent to surrender and the separate waiver of the speciality protection against prosecution for other earlier offences. These are separate declarations with serious legal consequences; they must not be treated as interchangeable or routine. Merely attending a hearing is not consent. For non-EU extradition, consent is governed instead by Criminal Procedure Code Art. 701; it can remove the ordinary court examination stage. Ask for legal advice and an interpreter before making either declaration.
Where is the person being held, and how can counsel visit?
The Ministry of Justice lists Bari's Casa circondariale Francesco Rucci at Corso Alcide De Gasperi 307, with visitor entry identified as number 309. Its current listing gives avvocati.cc.bari@giustizia.it for lawyers seeking interviews and rilasciocolloqui.cc.bari@giustizia.it for family-visit reservations; it also lists 080 564 0900 for family reservations after 14:00. The listing says a lawyer's email request should be sent at least 180 minutes in advance and include the lawyer's name, bar association, the detainee's full identity, and the requested date and time. Confirm the current process directly before travelling because schedules and arrangements can change.
Do not assume an arrested traveller is there. The person may initially remain with police, may be placed elsewhere for security, medical or operational reasons, or may be transferred in the wider Bari district. Defence counsel should confirm the place of custody through the arresting authority and the case record before arranging the prison appointment. A foreign lawyer generally needs coordination with counsel qualified to act in Italy; the prison does not itself decide whether surrender is lawful. For family access, distinguish an appointment request from judicial permission, where that permission is required. Bring identification and the exact name and birth date of the detainee.
What follows the first appearance at the court?
In an EAW case, the Bari Court of Appeal decides the surrender request. Under Law 69/2005, Art. 17, the decision must be made as soon as possible and normally within 15 days from execution of the coercive measure under Art. 9 or, where police arrest under Art. 11 applies, from the arrest itself; an extension of up to 10 days may be available under statutory conditions. Consent follows a distinct national procedure under Art. 14, so do not apply the non-consent clock mechanically. The EU Framework Decision separately provides 60 days from arrest in non-consent cases, extendable by a further 30 days in specific cases, and 10 days from consent. Confirm the operative national provision and consent record before calculating the deadline; EU time limits do not guarantee automatic release. In Lanigan, C-237/15 PPU (16 July 2015), the Court of Justice held that expiry of the EU period does not end the EAW procedure or alone require release; continued detention must not be excessive and requires an individual assessment.
For non-EU extradition, the Code of Criminal Procedure routes the foreign request through the Minister of Justice and prosecutor general, followed by judicial examination in the Court of Appeal unless the legally prescribed consent removes that stage. Article 704 requires notice of the substantive extradition hearing at least 10 days beforehand; that notice period is not the deadline for the first urgent-arrest review. Article 716 separately provides that the urgent-arrest measure is revoked unless the minister requests its continuation within 10 days from validation. The distinct provisional-measure rule in Art. 715(6) requires the formal extradition request and the documents under Art. 700 to reach the Ministry of Foreign Affairs or Ministry of Justice within 40 days of the Justice Minister's communication to the requesting state that the provisional coercive measure has been applied. The treaty basis is country-specific: counsel must verify whether a bilateral or multilateral treaty applies and whether Italy has made a relevant declaration or reservation; no single treaty should be assumed to cover every requesting state. Counsel should inspect which order and which statutory clock actually apply.
Validation of an urgent provisional arrest is distinct from the final decision on extradition. Do not assume that the validation hearing will decide every ground for refusing extradition: it is a separate, urgent stage, and counsel must determine the proper procedural stage for each objection. If the papers suggest a death-penalty or other fundamental-rights risk, tell defence counsel immediately and preserve the relevant documents. Counsel should decide how and when to raise the issue under CPP Arts. 698 and 705 and the applicable treaty; the validation order itself is not a final ruling on extraditability.
Which local decision can be challenged, and where?
A Bari EAW surrender judgment can be challenged before the Corte di cassazione by filing through the registry of the Court of Appeal that issued it. The deadline for an Art. 17 judgment is five days from legal knowledge of the judgment; an order in the Art. 14 consent procedure has a separate three-day deadline from legal knowledge of that order. Ordinary extradition follows CPP Art. 706 and the general deadline rules in Art. 585, not the EAW deadlines. Obtain every signed order and have counsel calculate the applicable deadline immediately; refusal grounds and further remedies are covered in the national guide to challenging extradition.
What should the family or foreign lawyer send to Bari counsel?
- The detained person's full name, other spellings, date of birth, citizenships and contact language; indicate whether they need an interpreter.
- The police station, airport or seaport, arrest date and clock time, any record number, and the arresting unit's contact.
- Every document actually served: SIS/EAW information, provisional extradition request, custody order, hearing notice and translations; photographs are helpful for the first call, originals for filings.
- Proof of lawful Italian residence, local home and family links when relevant, plus medical or care needs requiring immediate notification.
- Details of existing lawyers or criminal proceedings in the requesting country, including reliable translations of decisions when available.
- Whether the person has signed any consent or waiver, and the language and setting in which it was obtained.
Hypothetical example: a non-EU visitor is stopped at Bari airport on a request from a country outside the EU, and the family is told the arrest was “for extradition”. Bari counsel first obtains the provisional-arrest record and checks CPP Art. 716, rather than applying the EAW 24-hour rule. Counsel confirms whether the person and record were placed at the president’s disposal and whether validation occurred within the following 48 hours. Because police have up to 48 hours to transmit the record, the overall period can reach 96 hours from arrest. Counsel also confirms the custody location and when the ministerial continuation deadline expires. If the papers suggest a death-penalty or other fundamental-rights risk, counsel must assess immediately how and at what stage to raise it under the applicable treaty and Italian law; the validation order does not itself decide final extraditability. If the document is instead a valid EAW from an EU state, the EAW route and its separate deadlines apply.

Questions families ask about Bari
Can I call the Third Criminal Section instead of hiring a lawyer?
You can ask the registry about its administrative remit, but staff cannot give individual defence advice or promise access to confidential case papers. A qualified Italian defender should establish the file number and proper filing method.
Does a Red Notice mean Italy has already authorised extradition?
No. An international police notice is not a Bari Court of Appeal extradition judgment. Ask for the actual arrest basis, its judicial review and the foreign request.
Can a family member reserve a visit at Bari prison immediately?
First establish that the person is at Francesco Rucci. Then check the prison's current appointment and authorisation requirements; the published family-visit mailbox alone is not permission to enter.
Is Bari the right court when police arrested someone in Foggia?
Foggia is within the Bari appellate district, but the instrument, address and prior judicial acts can affect competence. Obtain the arrest report before directing filings to the Bari registry.
