Extradition by country

Extradition Lawyer in Yekaterinburg: Sverdlovsk Regional Court and the Local Procedure

For an extradition request involving a person located in Yekaterinburg, the decision to surrender is made centrally by the Prosecutor General of the Russian Federation or a deputy—not by the Sverdlovsk Regional Court. The Sverdlovsk Regional Court reviews a challenge to that decision when the person is located in Sverdlovsk Oblast, and Article 463 of the Code of Criminal Procedure sets a 10-day period from receipt of the notice. The local priorities are to identify the actual custodian, preserve the notice date, and send the correct filing to the court without delay.

Which Yekaterinburg institutions handle each stage?

InstitutionRole and practical point
Sverdlovsk Regional CourtReviews an Article 463 complaint for a person in Sverdlovsk Oblast. The official court portal lists 120 Moskovskaya Street, Yekaterinburg, and +7 (343) 227-06-10; verify the current filing channel and office hours before filing.
Second Court of Appeal of General JurisdictionHears the appeal; official records show criminal appeals from Sverdlovsk despite the court being based in Saint Petersburg.
Prosecutor General or deputyMakes the Article 462 decision on a treaty basis or reciprocity.
Sverdlovsk Regional Prosecutor’s OfficeAt 21 Moskovskaya Street, Yekaterinburg; the official regional page lists +7 (343) 377-60-93 and a structure that includes criminal-procedure and operational-search supervision. It cannot replace a court filing.
Koltsovo AirportPossible place of a stop or identification; airport staff do not decide extradition.

What is the deadline to challenge the extradition decision?

Article 463(1) gives the person or their lawyer 10 days from receipt of the written notice to complain to the regional-level court where the person is located. For someone in Yekaterinburg or elsewhere in Sverdlovsk Oblast, that is Sverdlovsk Regional Court. It is 10 days, not 10 working days. Keep proof of the receipt date and filing.

If the person is in custody, Article 463(2) requires the detention administration to forward a complaint addressed to the court immediately and notify the prosecutor. The prosecutor separately has 10 days to submit supporting materials; that period does not extend the defence deadline.

The court must review the complaint within one month of receipt, at an open hearing before one judge with the prosecutor, the person and their lawyer if participating. The court checks legality under Russian law and applicable treaties, not guilt. If the extradition decision is cancelled, the preventive measure must also be cancelled.

Under Article 463(9), the ruling may be appealed to the criminal division of an appellate court of general jurisdiction. Official records identify the Second Court of Appeal for criminal appeals from Sverdlovsk. Article 389.4 generally gives 15 days from pronouncement. Do not automatically apply the copy-delivery trigger stated for convicted people in custody to an Article 463 extradition complaint; counsel should verify the applicable trigger and filing directions. Cassation is a separate step.

How does detention differ from the extradition appeal?

Detention is separate from the extradition decision. Under Article 466 of the Code of Criminal Procedure, the actual custody order, the authority that issued it, the treaty basis of the request and compliance with Russian procedural limits must be checked. An Article 463 complaint does not by itself challenge detention.

For a request governed by the 1993 Convention on Legal Assistance and Legal Relations in Civil, Family and Criminal Matters, Constitutional Court Determination No. 333-O-P of 1 March 2007 explains that Article 466(1) does not permit detention on a foreign state’s request for more than 48 hours without a Russian court decision, or custody outside the procedure and time limits of Russian criminal procedure. Do not automatically extend this holding to Article 466(2): that provision concerns the different situation in which a foreign judicial authority has issued a detention order. The 1993 Convention does not govern every current request: the 2002 Chisinau Convention entered into force for Russia on 28 June 2023 and replaced the Minsk Convention in relations between its parties. Confirm which treaty governs the request.

Ask counsel to identify the custody order, the issuing authority, the start date and any extensions, and to determine the separate procedure for challenging it. The competent court and deadline depend on the order and procedural stage.

Where might a person be held in Yekaterinburg?

Do not assume that a detainee is at a particular facility. Public directories do not prove where an individual is held or what the current visit rules are. Before arranging access or sending original documents, ask the responsible authority or counsel to confirm the actual place of detention through the lawful procedure.

What if the arrest happens at Koltsovo Airport?

Koltsovo is Yekaterinburg’s airport, but the arrest location does not change who signs the extradition decision. Ask which authority recorded the stop, whether the person is formally detained, the legal basis and where they are being taken. Record the times, request copies of the documents and note the language used to explain rights. An international alert is not itself a decision by the Russian Prosecutor General to extradite someone.

The airport’s official site lists passenger information and +7 (343) 226-85-82. This is not a legal helpline or a source of confidential custody information. If family cannot locate the person, contact counsel and ask the responsible authority to confirm the place of detention through the lawful procedure. Do not post passport details or confidential case documents publicly.

Practical first-72-hour action plan

This is a practical plan, not a statutory 72-hour extradition deadline. The legal deadline depends on the notice, custody order and applicable treaty.

WhenActionPreserve
ImmediatelyConfirm identity, nationality, detention location, responsible authority and reference number. Ask for a lawyer and an interpreter if needed.Detention record, rights notice, identity document and officers’ details.
First dayHave counsel distinguish provisional arrest, an Article 466 custody measure, an extradition request and a formal extradition decision.Foreign warrant or judgment, translations, notice, custody order and any extensions.
When notice arrivesCalculate the 10-day Article 463 period and prepare a complaint to Sverdlovsk Regional Court. Obtain proof of submission or forwarding from detention.Notice, proof of receipt, dated complaint, attachments and filing receipt.
Before the hearingPrepare a chronology, evidence relevant to the legal grounds and qualified interpretation.Nationality/status documents, prior-proceeding and limitation evidence, and specific materials about alleged risks abroad.

What language and access rights should the family check?

Russian is the language of criminal proceedings. Under Article 18, a person who does not sufficiently know Russian may, in the circumstances provided by law, use a language they know and receive an interpreter free of charge. Tell counsel if the person did not understand the rights notice, signed an unfamiliar-language document or could not speak privately with counsel.

Family members do not automatically have a lawyer’s access rights. The actual facility may require proof of relationship, prior permission or a formal visit application. Confirm current rules before travelling or sending originals.

What should the local complaint focus on?

The Sverdlovsk Regional Court reviews whether the Prosecutor General’s decision complies with Russian law and the applicable treaty; it does not decide guilt. The specific refusal grounds and the nationwide extradition process are covered in the Russia refusal and appeal guide and the Russia country guide. For the local filing, give counsel the full decision, the notice and proof of its receipt date, together with documents relevant to the individual case.

A hypothetical Yekaterinburg example

Hypothetical: a Georgian citizen is stopped at Koltsovo and later receives notice of a Prosecutor General extradition decision. His sister has heard he may have been transferred to a detention facility in the region, but has no confirmation. She should confirm the actual place of custody, send the notice and receipt date to counsel, and have counsel assess an Article 463 complaint to Sverdlovsk Regional Court within the statutory period. If custody is disputed too, counsel must identify and challenge that order separately.

Frequently asked questions

Does Sverdlovsk Regional Court itself order extradition?

No. Under Article 462, the Prosecutor General or a deputy makes the decision. Sverdlovsk Regional Court reviews a complaint against that decision when the person is located in the region.

Is the Article 463 period 10 working days?

The statute says 10 days from receipt of the notice, not 10 working days. Preserve proof of the receipt date and have counsel calculate the final day under the procedural time-counting rules.

Will an Article 463 complaint automatically end detention?

No. Article 463 governs review of the extradition decision. The legal basis and duration of custody are separate questions and may require a separate challenge. If the extradition decision is cancelled, Article 463(8) requires cancellation of the preventive measure selected for that person.

Does an arrest at Koltsovo establish where a person will be held?

No. The arrest location does not establish the later place of detention. Confirm the actual institution through the responsible authority or counsel before arranging a visit or sending documents.
