Extradition by country

Extradition Lawyer in Antalya: Antalya ağır ceza mahkemeleri and the Local Procedure

An extradition case arising in central Antalya is ordinarily assessed for legal admissibility by an ağır ceza mahkemesi (high criminal court) in the competent judicial district, after the prosecutor and central Turkish authorities process the foreign request. A separate sulh ceza hâkimliği (criminal peace judgeship) can make the initial provisional-custody decision; an airport arrest is not itself an extradition order. The first judicial appearance is urgent, while the date of the later extradition hearing depends on when the official request reaches the appropriate court and how the file is allocated.

Which Antalya court has the extradition file?

The official Antalya courthouse directory lists Antalya 1st through 12th Ağır Ceza Mahkemeleri and six Sulh Ceza Hâkimlikleri. It does not identify one permanent, exclusive extradition chamber. Counsel must obtain the actual file reference and chamber from the courthouse or the prosecutor; assuming that every extradition request goes to Antalya 1st High Criminal Court risks contacting the wrong registry. Under Law No. 6706, Article 15, the competent high criminal court ordinarily relates to where the person is located. The Antalya Chief Public Prosecutor's Office (Antalya Cumhuriyet Başsavcılığı) is the local prosecutorial contact, not the final authority to surrender a person to another state.

Antalya province is not one court district for every purpose. The Alanya courthouse independently lists its 1st, 2nd and 3rd High Criminal Courts and a criminal peace judgeship. Antalya courthouse also identifies affiliated courthouses in Kemer and Korkuteli. Someone stopped in Alanya should therefore not send all papers blindly to Antalya city centre. Establish the arrest location, subsequent transfers, assigned prosecutor, custody order and court named in the summons before preparing a filing. The judicial venue must be verified against the individual case record.

An arrest at Antalya Airport may take a different practical path

Antalya Airport (AYT) serves international and domestic travel. An unusually important local development is the airport courthouse extension opened on 5 August 2024 by the Antalya Chief Public Prosecutor's Office. According to the courthouse, it handles processes relating to existing apprehension and detention orders, and allows some statements to be taken by the SEGBİS audiovisual system without transporting the person to the main courthouse. The published service hours are daily, including weekends, 08:30–20:30. These are office hours, not an extension of any statutory detention limit, a promise that a particular detainee will use the system, or proof that the airport office hears extradition merits.

For a traveller stopped at passport control, record the exact time, the identity of the police unit, whether there is an existing Turkish judicial warrant, and whether the person was interviewed through SEGBİS. Ask for the written judicial decision and the identity of the issuing court. An INTERPOL Red Notice is a request for cooperation, not an extradition judgment or an automatic power of detention. The Turkish Ministry's 2024 Circular No. 184 requires the relevant central review rather than treating the alert alone as sufficient for provisional extradition arrest. If the person was arrested on an unrelated domestic warrant, that legal basis must be separated from any later extradition case.

What actually happens after provisional arrest?

Law No. 6706 governs Turkish extradition practice, principally Articles 10–21. At the provisional stage, the competent prosecutor can refer a detainee to a criminal peace judge, who assesses detention or an alternative judicial-control measure. Article 14(3) requires the arrested person to be brought before a criminal peace judge within 24 hours; counsel should establish the precise arrest time and obtain the hearing record. This 24-hour rule must not be confused with a supposed guarantee that the heavy criminal court will hear the full extradition application in 24 hours.

Where the European Convention on Extradition applies, Article 16 permits release if the formal extradition request has not been received after 18 days of provisional detention and sets an outer 40-day limit for that provisional stage. The correct treaty, the day custody began and the date on which a legally sufficient request arrived must be established before relying on these figures. A 40-day limit on custody pending documents does not mean automatic release after a properly submitted formal request: subsequent detention and judicial review follow a different legal basis. Do not confuse provisional arrest, ordinary remand for a Turkish offence and immigration detention.

Once the official request has arrived, Article 16 of Law No. 6706 permits the assigned high criminal court to impose protective measures and requires review of continuing extradition detention at intervals of no more than 30 days. This is separate from the preliminary 18/40-day mechanism and should be checked against the court’s actual review decisions.

After the formal request is transmitted, the high criminal court examines admissibility; a person who does not consent normally has a court hearing under Article 18. A judicial finding that extradition is legally permissible is distinct from a subsequent executive surrender decision. Turkish nationality, identity, double criminality, applicable treaty conditions and the actual request documents may require examination, but the detailed nationwide grounds and objections are addressed in the Turkey extradition procedure guide and remedies and appeals guide.

A further and separate safeguard appears in Article 16(3): if the high criminal court's ruling accepting the extradition request becomes final, but no executive extradition decision under Article 19 is made within one year of that final ruling, the protective measures imposed on the person must be lifted. This clock starts with finality of the court ruling, not the airport arrest; it must not be confused with the provisional-arrest time limit. Any independent ground for detention would require separate assessment.

The first 72 hours: an Antalya action plan, not a legal deadline

The following periods are organisational targets for relatives and defence counsel. Seventy-two hours is not a statutory deadline for the Antalya extradition court to rule. The separate 24-hour initial judicial-appearance requirement applies where Article 14(3) is engaged; later hearing dates and procedural filing windows must be checked from the documents served.

Practical windowWhat to establishWhat to preserve or request
Immediately to 24 hoursFind the exact airport/police arrest time, location and legal basis; identify the prosecutor and criminal peace judgeship.Ask for lawyer and a qualified interpreter; obtain apprehension minutes, order and any SEGBİS record.
24 to 48 hoursIdentify the assigned high criminal court if a formal file exists; determine whether documents came through the Ministry.Preserve foreign warrant, translated papers, court decisions and identity documents; ask counsel to assess detention and judicial control.
48 to 72 hoursConfirm the actual detention facility, access arrangements, and next hearing or review date; check any transfer to Alanya or another district.Prepare proof of residence and family ties, medical records where relevant, and consular/contact permissions without assuming an immediate visit.

Where is the detainee held and how can relatives visit?

Antalya L Type Closed Penal Institution in Döşemealtı officially accommodates detained persons as well as convicted prisoners. The Antalya justice website also lists other institutions, including an S Type Closed Penal Institution. Neither listing proves that a particular person arrested at the airport has been transferred there. Before a relative travels to a prison, ask the authorised lawyer to confirm the named institution, admission status and visitor rules; the person may remain in police or other temporary custody or be moved.

Visiting rules have a particularly important requirement for foreign families. Article 27 of the Regulation on Visits to Convicts and Detainees, published on the Antalya S Type institution's official website, requires qualifying relatives of foreign detainees to seek advance approval from the public prosecutor's office with evidence of the relationship, personal identity information and a copy of the visitor's passport or ID. Once approved, an identification document with a photograph is issued for subsequent visits, subject to institution checks. Additional permissions apply to some categories of visitor or allegation. A foreign daughter or spouse should therefore carry documentary proof of the relationship and should not expect that appearing at the gate with a passport alone guarantees entry.

Interpreter and lawyer access at the Antalya courthouse

Turkish is the working language of the proceedings. Criminal Procedure Code No. 5271, Article 202 provides for interpreter assistance where a suspect or defendant cannot sufficiently explain themselves in Turkish; appointment and the completeness of translation should be addressed before a statement or consent is recorded. The Antalya courthouse published an October 2026 invitation to applicants for its 2027 interpreter register. That notice demonstrates a local roster process, not that a particular language is immediately available or that an informal bilingual airport employee substitutes for an appointed interpreter.

Give local defence counsel the language and dialect required, passport spelling, nationality, whether the detainee understands written Turkish, any hearing notice and the name of the interpreting person already used. Ask specifically whether the full translated accusation and request are on file. It is unsafe to consent to extradition on the strength of a quick airport explanation that the person did not fully understand. Under Article 17, consent to simplified extradition is a distinct procedural choice; any additional declaration affecting the speciality rule should be checked and translated separately.

Can detention or an Antalya extradition decision be challenged?

First identify which decision exists. An initial criminal peace judgeship detention order and later detention-review decisions call for their own timely custody challenge and review under the applicable Criminal Procedure Code rules; counsel should examine the signed order and notification date, rather than treating an appeal against surrender as an answer to immediate custody. A contested extradition admissibility judgment of the high criminal court follows the Law No. 6706 Article 18 route to the Court of Cassation (Yargıtay), whereas a decision recorded following consent engages a different objection route. The Antalya Regional Court of Appeal is not automatically the ordinary destination for an Article 18 extradition challenge.

For decisions issued on or after 1 June 2024, an ordinary objection (itiraz) under Criminal Procedure Code Article 268, where that route applies to a custody or consent-based decision, is generally due within two weeks of learning of the decision. The separate cassation appeal (temyiz) against a contested admissibility judgment under Law No. 6706 Article 18 generally must be filed within two weeks of service of the reasoned judgment (Criminal Procedure Code Article 291, as amended by Law No. 7499). Article 18(4) gives Yargıtay three months to decide; that is not a filing period. Transitional rules may differ for earlier decisions, and counsel must check the precise order, competent filing office and proof of service. Separately, Article 16(4) caps total extradition custody by the executable term of the penalty faced or imposed; it does not extend the treaty's provisional-arrest period.

The lawfulness of continuing extradition detention depends on the signed order, individualized grounds, the stage of the foreign request and the actual dates of court review. A judgment concerning someone else's custody does not automatically secure release in Antalya. Counsel should check current binding case law and pursue the proper, timely custody objection separately from any appeal against admissibility.

Example: a Red Notice stop during a holiday

Hypothetical: A foreign citizen lands at Antalya Airport for a week-long holiday and is taken aside because a foreign state has requested action on an INTERPOL notice. Their partner calls from abroad after hearing only that the person has been “sent to court”. The useful questions are not simply “Can INTERPOL extradite them?” but “Did Turkish authorities authorise a judicial apprehension process; was the person presented to a criminal peace judge within the applicable period; did an airport SEGBİS interview occur; and has a formal request been transmitted to a numbered Antalya high criminal court?” A lawyer can request the relevant records, identify which legal phase has begun and prevent an unrelated airport interview from being mistaken for a final extradition hearing.

Documents relatives and foreign counsel should send first

  • Full name exactly as in the passport, other spellings, nationality, date of birth and copies of identity documents.
  • Antalya Airport flight and terminal details, resort or police-station location, exact detention time and last contact.
  • Any Turkish arrest record, court heading, prosecutor reference, SEGBİS notice or translated document received.
  • The requesting state's warrant and charges, case identifiers, existing judgments and accurate translations, if available.
  • Evidence relevant to individual custody assessment: local address, family and employment ties, medical needs and available guarantors.
  • For a family visit, relationship documents, passport copy and the required prosecutorial visitor approval; verify the actual prison first.

A single precise question to the local lawyer is more useful than sending an unverified Red Notice screenshot to every courthouse: “Which authority currently controls this person's liberty, under which order, and what is the next challenge or appearance?” The next answer determines whether counsel must act before a criminal peace judgeship, an assigned Antalya or Alanya high criminal court, or on the central extradition dossier. Lex Agency can coordinate cross-border case preparation with independently instructed Turkish counsel; request a case assessment with the documents already available.

Frequently asked questions

Is an airport video interview the extradition hearing?

No. The airport unit can process specified judicial steps and remote statements, but a contested extradition assessment belongs to the competent high criminal court. Ask what type of hearing occurred and request the record.

Does an INTERPOL Red Notice itself require extradition?

No. Turkish authorities have to apply domestic law, relevant treaties and the applicable judicial procedure; the alert does not substitute for those decisions.

Will an Antalya arrest always be heard in central Antalya?

No. Alanya has its own high criminal courts and a resort arrest or subsequent transfer can raise jurisdiction questions. Verify the assigned court from the actual papers.

May my relative go directly to the prison for a visit?

Not safely without confirming the detention facility and seeking any required visitor authorisation. Foreign-national detainees' family visits are subject to a documentary approval process under Article 27 of the visiting rules.
