Extradition by country

Extradition Lawyer in Izmir: Izmir ağır ceza mahkemeleri and the Local Procedure

In an extradition case involving a person found in Izmir, the competent ağır ceza mahkemesi (high criminal court) decides whether a foreign request is legally admissible; the Izmir prosecutor's office brings the matter before that court. It is not the court that alone orders the person sent abroad. If somebody has been stopped at Izmir Adnan Menderes Airport, immediate priorities are to identify the arresting authority, distinguish provisional arrest from an already-filed extradition request, and obtain a lawyer and interpreter before any decision about consent.

Which Izmir authority is dealing with the case?

Article 15 of Law No. 6706 assigns the extradition-admissibility decision to the high criminal court for the place where the person is found, not automatically to the court nearest their hotel or the requesting country's embassy. The Turkish Ministry of Justice, as central authority, screens incoming material and sends a qualifying request to the competent Cumhuriyet başsavcılığı (chief public prosecutor's office); the prosecutor then seeks a decision from the ağır ceza mahkemesi. If the person's location is unknown, the statute points to Ankara instead. Court-file identification therefore comes before assumptions about venue.

The official Izmir courthouse directory places its high criminal courts, criminal peace judgeships and prosecutor's office at the main Konak site. There are also affiliated courthouses, including Menderes Adliyesi at Kasımpaşa Mahallesi, Çevre Yolu Üzeri 250 Sokak, Menderes. Do not assume an arrest anywhere in Izmir Province is necessarily assigned to the central İzmir court: counsel should establish the person's actual location, local judicial boundary, the referring prosecutor and the numbered court in the case record.

An arrest at Adnan Menderes Airport is not an extradition ruling

State airport operator DHMİ identifies İzmir Adnan Menderes Airport as ADB, with both domestic and international traffic, in the Gaziemir area. In September 2026 the Izmir judiciary published the existence of an airport judicial service unit. Its existence matters operationally: ask whether the person is still with airport police, has appeared before a criminal peace judge, or has been transferred to another judicial or custodial site. Do not equate a police stop, an INTERPOL Red Notice, a provisional detention order, a regular criminal warrant and a formal extradition request.

Under article 14(3) of Law No. 6706, a person arrested on the specified provisional-extradition pathway must be brought before a sulh ceza hâkimi within 24 hours of being apprehended. The judge considers provisional detention, judicial control or release and must explain the possibility and legal consequences of consent. That 24-hour rule is not a promise that an ordinary extradition hearing before the high criminal court will happen within a day. Airport arrangements and a person's precise referral should be verified immediately through the lawyer rather than inferred from publicity about faster airport services.

The official page headed “İzmir Adnan Menderes Havalimanı Ek Hizmet Birimi” repeats the main Konak courthouse address and general switchboard; it does not establish a separate street address for an airport extradition court. Ask Izmir counsel to confirm the actual airport unit, arrest referral and judicial file before directing relatives to either site.

First 72 hours: a practical checklist, not a statutory 72-hour deadline

After transfer or first judicial appearanceCurrent custody institution, court and prosecutor file numbers, interpreter arrangements and any order's date of service.Contact the correct institution; ask counsel for a copy of the detention order and the next review date.
As formal papers arriveWhether the full request reached the Ministry, the applicable treaty, the assigned ağır ceza mahkemesi, and documents still missing.Check the extradition bundle with Turkish counsel; prepare dated evidence without treating the provisional deadline as a blanket release date.

For a hypothetical example, a Georgian passenger is stopped at ADB after a foreign alert. Their family should not ask, “Which court extradited them?” before learning whether there is merely an article 14 provisional detention decision. The first lawyer must identify the criminal peace judge and the clock starting at apprehension. If a formal request later reaches the central authority, the assigned high criminal court and another set of custody rules matter. Those are different decisions requiring different documents.

How long can detention last, and who checks it?

For provisional custody before the extradition documentation arrives, article 14(4) makes the applicable treaty decisive. Where the European Convention on Extradition applies between the states concerned, its article 16 allows consideration of release if the complete request is not received within 18 days and provides a 40-day outer limit for that provisional stage. Under reciprocity without a controlling treaty, the Turkish statutory maximum is 40 days. These are not universal maximums for every subsequent extradition detention. Article 14(6) requires the provisional measure to be lifted if the requesting state does not send the necessary papers within the applicable limit, but expressly permits fresh measures after receipt of a proper extradition request.

Once the case enters the formal process, article 16 allows the ağır ceza mahkemesi to order measures under the Criminal Procedure Code. If detained, the person's custody must be examined at intervals of no more than 30 days until surrender. The same article limits total extradition detention by reference to the sentence likely to be imposed or already imposed, and requires protective measures to be lifted if no article 19 surrender decision is made within one year after the court's admissibility decision becomes final. These are separate clocks. Turkish Constitutional Court decision Samira Alakbarova (no. 2018/19302, 22 February 2022) found a rights violation after prolonged detention where courts failed to examine proportionality and alternatives sufficiently; it does not automatically release every extradition detainee. Counsel should calendar arrest, delivery of documents, custody reviews and finality, and seek an individual assessment.

Where is a person detained in the Izmir area?

The İzmir justice directory confirms distinct institutions, including İzmir 1 and 2 No. F-type high-security closed prisons in Kırıklar, Buca, and İzmir 1–4 No. T-type closed prisons in the Aliağa/Yenişakran campus. It also lists Menemen facilities. This directory does not establish that extradition detainees are automatically assigned to any one of them. A person's holding place can change. Families should obtain the exact full institution name and inmate or custody reference from the lawyer or competent authorities before arranging travel, parcels or visits.

Ask the lawyer to confirm how attorney meetings are arranged at that facility, the documentary requirements for family visits, whether remote communication is possible, and any applicable security restrictions. These are institution- and status-dependent; the existence of a prison on an official list is not evidence of its visitor hours or that the person has been transferred there.

Interpretation and the first substantive hearing

The official İzmir first-instance justice commission issued a call on 8 October 2026 for applications to its 2027 interpreter list. That is evidence of a local court-interpreter administration, not a guarantee that every requested language will be instantly available. Tell counsel the detainee's actual spoken language and any literacy or dialect issues. A person should understand the foreign allegations, the judge's questions, the meaning of consent and the written order; do not use a family member as an assumed substitute for a formal judicial interpreter.

There is no verified Izmir-wide fixed waiting period for the first substantive extradition hearing. It depends on arrival and completeness of the foreign request, court allocation, service and the person's custody status. Under article 18(2), the court may request missing information through the authorities. The right practical question is therefore: “Has the Ministry transmitted the full request, and what is the court's next recorded hearing date?” rather than accepting an invented local average.

Before the first substantive admissibility hearing, ask the assigned court and lawyer whether the foreign extradition request, its supporting papers and the hearing date were properly served and whether the person has had a practical opportunity to prepare with an interpreter. Law 6706 article 5 makes the Criminal Procedure Code applicable where no special rule displaces it; CPC article 176 concerns summons and supporting documentation. A quick appearance following arrest should not be mistaken for a fully prepared article 18 hearing. Record any missing papers or interpretation problem in a timely application to the court.

What follows an Izmir court's admissibility decision?

For the ordinary, non-consensual route, article 18(4) provides temyiz review by Yargıtay, not the ordinary regional istinaf route through the İzmir Bölge Adliye Mahkemesi. Under Criminal Procedure Code article 291 as amended with effect from 1 June 2024, the ordinary filing period is two weeks from service of the judgment with its reasons; counsel must verify the date and method of service, the individual decision and any applicable transitional provision. The statute instructs Yargıtay to dispose of the extradition appeal within three months, which is not a promised total time from the airport arrest to release or surrender.

The Yargıtay Grand General Assembly’s 29 June 2026 division-of-work decision assigns Law 6706 matters newly arriving after the allocation takes effect to Yargıtay 5th Criminal Chamber. This is a chamber within Yargıtay, not a second first-instance court in Izmir. For an older, already pending or transferred file, counsel must inspect the actual Yargıtay docket and transitional allocation provisions instead of assuming that chamber. This administrative allocation does not extend the filing deadline.

The regional appeal court has a real courthouse in Konak and covers İzmir, Aydın and Manisa, but its existence does not change this express statutory route. A consent-based extradition decision under article 17 instead provides an itiraz objection and a different approval mechanism. The court's admissibility decision is also separate from subsequent executive approval under article 19; neither a positive court decision nor a Red Notice by itself equals physical surrender. Specific grounds, suspensive measures and wider appeals belong in the dedicated Turkey remedies guide; the national sequence is explained in the Turkey extradition guide.

What should the family or foreign lawyer send first?

  • The person's full legal name as on every passport, date of birth, nationality or nationalities, passport scans and possible transliterations.
  • The exact time and location of the Izmir stop, any document or photograph showing the acting authority, and the last confirmed contact.
  • Every available foreign warrant, Red Notice reference, criminal-case number and translation; distinguish what was personally seen from rumour.
  • Copies and dates of Turkish detention, control or court orders; the full name of the holding institution if known.
  • The person's language, medical or accessibility needs and a reliable emergency contact; send sensitive records securely to retained counsel.
  • Any evidence bearing on an identity mismatch or a local logistical question; ask counsel to decide how and when to submit it.

For work done from abroad, agree with Turkish counsel who will obtain the Izmir file, visit the person, communicate with the consulate and keep the family informed after each court listing. A lawyer in the requesting country can explain the originating warrant but cannot replace local representation before Turkish authorities. Izmir's new airport service point, dispersed custody estate, and direct-to-Yargıtay court route make locating the actual file more valuable than relying on a generic airport-arrest script.

Questions families ask about Izmir

Can the high criminal court hold the extradition hearing at the airport?

The official Izmir site identifies a judicial service point at Adnan Menderes Airport, but it does not identify it as a substitute for the competent ağır ceza mahkemesi. Ask for the assigned court and written notice of the hearing; do not assume the airport office determines admissibility.

Does the 40-day period mean automatic final freedom?

No. It concerns the applicable provisional-arrest stage if the necessary request documents have not arrived. Later detention following a formal request is governed by different provisions and must be independently checked.

Should relatives go directly to the Aliağa prison campus?

No. Multiple separate institutions operate there, and the directory does not locate a particular detainee. Confirm the exact prison or holding unit before travelling.

This site's team can coordinate cross-border defence with independently retained local counsel; send a confidential case enquiry.
