Extradition by country

Extradition Lawyer in Jeddah: Local Arrest Procedure

A person stopped in Jeddah following a foreign alert needs to establish who took custody, on what written authority, and under which procedure. Jeddah has a Criminal Court, but that does not establish a routine extradition hearing before it. A Saudi lawyer should trace the arrest and the responsible prosecution office; no verified rule fixes a first extradition hearing or surrender deadline specifically in Jeddah.

The airport and the port create different custody trails

At King Abdulaziz International Airport, the General Directorate of Passports processes international passenger movements. Airport security, passport control and customs have different functions. Record the flight, terminal, date, time, last contact, stopping unit and reference number. An immigration issue, a Saudi criminal order, a foreign request and an INTERPOL alert are not interchangeable.

At Jeddah Islamic Port, Port Passports handles international passengers. An official 2022 report described four Border Guard inspection devices, and reports in May and June 2026 show Border Guard operations at the port. Preserve the ship name, pier, passenger hall, arrival or departure details and any maritime movement record. These are useful local leads not present at Riyadh airport; the presence of several services does not prove which one arrested the person.

An INTERPOL Red Notice is a request to locate and provisionally arrest, not an international arrest warrant. Saudi law determines whether an actual detention is authorised. Ask for the domestic basis and see how to check for a Red Notice.

Which Jeddah institution has the document?

Institution or place Verified local role What the lawyer should establish
Jeddah Criminal Court (المحكمة الجزائية بجدة) Operating criminal court, reported June 2026 Is a Saudi criminal charge filed there? No automatic extradition competence established.
Makkah Region Public Prosecution branch (فرع النيابة العامة بمنطقة مكة المكرمة) Regional prosecution branch, reported July 2026 Which investigator holds the custody or transfer order?
Jeddah Governorate Police (شرطة محافظة جدة) Police directorate documented June 2025 Did police arrest or receive a person from a border unit?
King Abdulaziz International Airport Air border, with Passports processing Terminal, flight and the unit making the stop.
Jeddah Islamic Port Sea border, with Port Passports and Border Guard Vessel, quay and who assumed custody.
Makkah Region Court of Appeal (محكمة الاستئناف بمنطقة مكة المكرمة) Historical official decision shows an appellate panel in Jeddah Only for a Saudi judgment, verify current circuit and appeal rules; no extradition appeal is proved.

A Saudi Press Agency notice from June 2022 separately identifies the head of Jeddah Public Prosecution. It documents a local prosecutorial presence at that date, not the officer responsible for the present file; the lawyer must verify the current case assignment.

A Ministry of Justice administrative office cannot be assumed to decide surrender. Start with the issuer, signature and type of the actual paper, not a generic court address.

If the stop in Jeddah becomes a Saudi criminal investigation run by a department elsewhere, Article 110 of the Law of Criminal Procedure requires initial checks by the investigation department where the arrest occurs; if transfer is necessary, the accused must be told the destination. Article 111 requires the investigator to be informed if the accused objects to the transfer or is medically unfit. Ask the Jeddah lawyer to record the receiving office, transfer date and destination, rather than assuming the person remains at the port or airport. These are domestic-investigation rules, not a verified extradition-transfer protocol.

First 72 hours: a practical plan, not a legal extradition clock

Seventy-two hours is a practical checklist, not a statutory surrender deadline. Different detention rules may apply to a domestic Saudi investigation; do not transfer their clocks automatically to a foreign request.

Stage Practical action Purpose
Immediately Save passport identity, flight or vessel, place, time, witnesses and all notices Identify the custody trail.
First lawyer contact Verify holding authority, written grounds, interpreter and lawyer access Decide whether to approach police, prosecution, immigration or an existing court.
Questioning Ask whether there is a Saudi offence, only an alert, or a formal foreign request Separate different legal processes.
Detention document found Check date, investigator, duration, extension authority and complaint procedure Avoid mistaking a domestic deadline for extradition release.
Following days Reconfirm actual facility, health needs, communication and any required authorisation Transfers can occur after airport or port processing.

Domestic criminal detention provisions—and their limits

For a Saudi criminal investigation, article 4 of the Law of Criminal Procedure recognises assistance by counsel during investigation and trial. Article 34 sets a 24-hour period for the criminal-investigation officer to refer a suspect and another 24 hours for the investigator to question and decide upon receipt; Implementing Regulation article 20 specifies when each period begins. Articles 109 and 116 address questioning, grounds of detention and contacting another person. Regulation article 22 requires notice of the rights to a lawyer and to contact someone. Verify that these rules actually govern the custody order.

Law article 113 allows an initial investigator detention order of up to five days from arrest. Article 114 provides extensions to an aggregate 40 days, then periods of up to 30 days each with an aggregate 180 days, followed by referral or release, subject to exceptional reasoned court-authorised extension. These are not automatic extradition hearing or release deadlines, and do not establish a Jeddah Criminal Court appearance within five days.

For that domestic investigation, article 115 permits a complaint against a detention order or extension to the appropriate head of investigation, branch or prosecution hierarchy; it must be decided within five days after submission. This is not a five-day deadline for appealing extradition and not automatically a criminal-court filing. The precise order must be inspected. Ordinary appeals of Saudi criminal judgments are different from any challenge to foreign surrender; no verified Jeddah extradition appeal precedent is asserted here.

Surrender, a Saudi charge and immigration removal are distinct

Basic Law of Governance article 42 leaves extradition rules to legislation and international agreements. As a sector-specific example, Saudi anti-money-laundering law article 41 and its rules refer to agreements or reciprocity, dual criminality and supporting documents. This is not a general Jeddah extradition code. The requesting state, instrument and alleged offence require individual verification. Saudi Arabia is outside the EU European Arrest Warrant system.

A Saudi prosecution may reach Jeddah Criminal Court; a foreign surrender request seeks transfer abroad; immigration removal is an administrative route. Ask for each decision's exact title. See extradition versus deportation, the Saudi country guide and the remedies guide.

Detention facility and access for relatives

An official 2019 report names Briman Prison in Jeddah, but establishes neither its use for extradition detainees today nor where this person is held. Do not visit a prison on the strength of a search result. Counsel should confirm the registered facility, access and visit procedure, and request interpretation when required; an English-speaking airport officer is not a promised interpreter for formal questioning.

A properly authorised representative may access judicial electronic services for an actual Saudi court case, not as proof of police custody. Families should provide passport name, birth date, nationalities, residency number if any, flight or ship, case references, medical needs and a dated chronology. Ask if a power of attorney is necessary. For foreign nationals, ask about consular notification and access under the applicable treaty and facts; do not assume an automatic visit.

Hypothetical: stopped at the maritime terminal

Hypothetical: a visitor disembarks at Jeddah Islamic Port and relatives hear that another country wants him. They preserve vessel and port records, then ask Saudi counsel to find the unit that assumed custody and the written grounds. Port Passports and Border Guard operate there, but this alone identifies no arresting officer. Counsel separates an alert from a formal request and any Saudi charges, seeks contact and language assistance, and verifies any available detention complaint. A hearing the next morning cannot responsibly be promised.

What to send the Jeddah lawyer

  • Passport spelling, birth date, nationality or dual nationality, residency identifier if available; avoid public sharing.
  • Airport terminal and flight or vessel, quay, entry point, exact time and witnesses.
  • Copies of arrest, detention, immigration, summons or prosecution papers with issuing authority, dates and numbers.
  • Any confirmed Saudi court case, hearing date and properly authorised electronic access.
  • Health and medication needs, interpreter language and consular-contact request.
  • Ask: domestic investigation, foreign surrender, immigration removal or several proceedings? Who may review this custody and what starts each deadline?

Confirm custody and procedure before predicting any outcome. The site's team can coordinate cross-border defence with separately instructed Saudi counsel: confidential enquiry.

Questions families ask after a Jeddah stop

Must everyone appear before Jeddah Criminal Court?

No verified rule establishes that court as the standard extradition tribunal. It may act if Saudi charges are filed; inspect the actual case.

Is a Red Notice a Saudi arrest warrant?

No. INTERPOL says it is not an international arrest warrant. Request the Saudi legal basis for detention.

Does the five-day rule govern extradition?

Not automatically. The initial five days concern a domestic investigative order; article 115 gives five days from filing to decide a domestic detention complaint.

Should relatives go straight to Briman Prison?

No. The historical official reference proves the place existed, not the present detainee's location or visiting permission.
