Extradition Lawyer in Riyadh: Riyadh and the Local Procedure
In Riyadh, an international police alert may first reach the Saudi INTERPOL National Central Bureau, which is based in the capital, but that bureau is not an extradition court. The Public Prosecution is central to reviewing criminal matters, while the exact decision maker, detention basis and transfer route must be confirmed from the actual request and applicable treaty. No verified public rule establishes a fixed first extradition hearing in a named Riyadh chamber or a standard number of days from airport interception to surrender.
Which Riyadh institution is actually handling the request?
The useful starting point is the reference number and issuing authority, not a speculative court date. Article 1 of the Public Prosecution Law, as amended in 1441 AH, places the Public Prosecution's headquarters in Riyadh and describes its institutional independence. INTERPOL identifies its Saudi National Central Bureau (NCB) as situated in Riyadh and part of the Ministry of Interior. The NCB facilitates international police information; a Red Notice is not itself a Saudi arrest warrant or an extradition judgment.
For a request concerning money laundering, clause 41/5 of the Anti-Money Laundering Law Implementing Regulation, updated on 26 June 2026, gives the General Directorate of International Police (Saudi INTERPOL) responsibility for receiving and sending extradition requests and referring them, as appropriate, to the Public Prosecution, the Oversight and Anti-Corruption Authority, or the Presidency of State Security. This identifies a request-routing function, not the official authorised to make a final surrender decision or a court hearing the challenge. Counsel in Riyadh should ask whether a formal request has arrived, which of those bodies received it, and whether the matter is actually within the money-laundering rules. The clause must not be assumed to cover every foreign criminal allegation.
| Institution | Verified Riyadh link | Question for local counsel |
|---|---|---|
| Public Prosecution (النيابة العامة) | National headquarters in Riyadh under the amended Public Prosecution Law | Which branch or investigator has the person's file and which written order authorises custody? |
| INTERPOL National Central Bureau Riyadh | Saudi NCB is in Riyadh, within the Ministry of Interior; it shares police information with border authorities | Is this a notice, a diffusion, a domestic warrant or a formally received extradition request? |
| Criminal Court in Riyadh (المحكمة الجزائية بالرياض) | Its ordinary criminal-court role in Riyadh is documented in an official Saudi Press Agency report of 27 August 2024; no extradition jurisdiction is established | Is there an actual Saudi criminal prosecution before this court? Do not assume it decides extradition. |
| Saudi courts of appeal | They review appealable first-instance judgments under the ordinary judicial system | Has an appealable domestic criminal judgment been issued, or is this a distinct administrative/international-cooperation request? |
| Unified security operations 911 | Riyadh has a regional emergency coordination centre serving the city and surrounding governorates | Use 911 for an immediate safety emergency, not as a case-status or defence filing service. |
A “specialised court” label does not establish a Riyadh extradition chamber. Ordinary criminal and appeal jurisdiction is not proof of competence over surrender. Counsel needs the request, referral order, case number and identified decision maker.
What changes if the person is stopped at King Khalid International Airport?
Saudi aeronautical information designates King Khalid International Airport OERK, 35 kilometres north of Riyadh, with customs and immigration listed H24. This is a possible border contact point, not proof of all-hours lawyer access or airport power to order extradition.
INTERPOL says Riyadh NCB gives customs and border posts access to its international databases. The first airport record might therefore be a database hit, not a surrender order. Counsel should distinguish entry refusal, immigration proceedings, a domestic arrest and detention on a foreign request. Preserve flight, passport, last-contact time, officer agency and served papers; do not presume a transfer destination.
Hypothetical example: A Georgian national arriving in Riyadh is questioned after a Red Notice from another country appears in a database. The family has only a photograph of an airport receipt. The appropriate first action is to authenticate the individual's location and custodial authority and identify the Saudi legal order, if any. It would be wrong to assume that a Red Notice automatically creates a Riyadh extradition hearing or that the traveller has already consented to surrender.
The first 72 hours: an action plan, not an extradition deadline
These intervals are practical priorities, not statutory extradition deadlines. Ordinary Saudi criminal-procedure clocks cannot automatically be applied to custody solely on a foreign request.
| Practical window | What to confirm | What to preserve or request |
|---|---|---|
| Immediately after contact stops | Full name, date of birth, nationality, last location and whether contact was at OERK or within Riyadh | Boarding pass, booking reference, time-stamped messages, names of accompanying passengers |
| Same day, if possible | Which law-enforcement or prosecution unit currently has the person; whether custody is domestic, immigration-related or extradition-related | Copy or identifier of the written order, stated reasons, consular contact request, lawyer's authorisation |
| Next one to three days | Whether a new written extension, transfer decision or court process has occurred and which authority can receive an application | All orders in date order, interpreter needs, medical evidence, translated warrant and treaty documents |
For domestic investigations, Criminal Procedure article 33 restricts police detention beyond 24 hours without a written investigator order. Article 34 sets 24-hour referral and interrogation steps, with separate triggers clarified by implementing regulation article 20. Articles 113–114 allow initial investigator detention up to five days, followed by extension thresholds of 40 and 180 days from arrest, and exceptional judicial extensions. These are not universal extradition custody limits. Verify the applicable instrument, initial order and exact clock trigger.
How can a detained person and family verify access to a lawyer?
Criminal Procedure article 116 requires notification of arrest or detention reasons and supervised contact with a person chosen by the detainee; article 2 bars unlawful detention and mistreatment. Counsel should establish whether those provisions apply, whether contact was requested and any lawful restrictions. Silence on a phone does not prove secret detention or a general right to an unscheduled visit.
Neither the custody facility nor visiting hours can be inferred from an OERK stop. Counsel should verify the holding authority and authorised visit channel. Record the detainee’s preferred language and request interpretation before interviews or statements; obtain an explanation before signing any untranslated admission or surrender consent. Verify lawyers through the Saudi Bar Association register and current licence.
For a foreign national, ask the appropriate consulate about access, subject to applicable consular rules and the detainee’s wishes. Consular officials do not replace Saudi lawyers or order release. Riyadh’s 911 service handles emergencies, not extradition pleadings.
Which local order is being challenged, and where does the application go?
First identify the decision. A domestic investigative detention order may engage the complaint mechanism in article 115 of the Law of Criminal Procedure: the detainee may complain to the head of the investigator's division, branch or authority, as appropriate, with a five-day period for a decision from lodging the complaint. Whether that route is available for extradition-only detention is a matter for verification in the individual file; it is not a universal appeal from an international surrender decision.
Ordinary appeals of eligible Riyadh Criminal Court judgments follow the criminal judicial hierarchy; they are not a generic extradition appeal. Immigration removal also differs from criminal surrender. Identify the treaty and receiving authority before choosing any remedy. The country remedies guide covers refusal grounds and challenges; no unsupported local appeal period is asserted here.
Saudi Basic Law article 42 assigns extradition rules to legislation and international agreements. Money-laundering rules, including implementing regulation article 41, address treaty or reciprocity, documents and dual criminality for that offence; they do not govern every offence identically. See the Saudi country guide. The EU European Arrest Warrant does not apply to Saudi Arabia.
What exactly should a family or foreign lawyer send to Riyadh counsel?
- The person's names in every script used, birth date, citizenships, passport or residence reference and last confirmed contact.
- The exact airport terminal or Riyadh district, travel itinerary and time-stamped evidence of the last encounter.
- Every arrest note, request, warrant, police notice, case number or transfer order; separate originals from translations.
- The requesting state's identity, criminal case number, suspected offences and copies of judgments or warrants if available.
- Details of any urgent medical or interpretation need, together with the name of the relative authorised to communicate.
- A written list of unanswered questions: location, legal basis, investigating officer, competent reviewer, next date and record-access method.
Send sensitive documents securely to the verified lawyer rather than posting passports or allegations publicly. Distinguish observed events from inference. Counsel can then test whether the file concerns Saudi charges, immigration or foreign surrender.
Unlike Jeddah, Riyadh hosts the national INTERPOL NCB and Public Prosecution headquarters alongside the OERK entry point. That affects tracing information, not proof of an exclusive extradition court. See the Jeddah guide for its separate arrival context.
Questions families often ask
Can a Red Notice by itself authorise extradition?
No. INTERPOL describes it as a request to locate and provisionally arrest; a country decides independently what legal force and arrest powers apply.
Is there a guaranteed first hearing within 24 or 48 hours?
No Riyadh-specific extradition hearing deadline was confirmed. The ordinary criminal investigation rules mentioned above are not an automatic timetable for extradition-only custody.
Should we contact the Criminal Court in Riyadh first?
Not without identifying an actual court file. First establish whether the case is being handled by the police, Public Prosecution, immigration authority or a court.
Can an overseas lawyer appear without Saudi credentials?
Do not assume so. Check current licensing and rights of audience with the local practitioner, using the Saudi Bar Association register.
