Extradition by country

Extradition Lawyer in Abu Dhabi: Abu Dhabi Judicial Department and the Local Procedure

An extradition arrest in Abu Dhabi requires two immediate checks: which prosecution has custody of the file, and whether the matter belongs to Abu Dhabi's local judicial system or the federal courts sitting in the emirate. Federal Law No. 39 of 2006, as amended in 2023, assigns the extradition assessment to a competent Court of Appeal, but Abu Dhabi Judicial Department (ADJD) is not a synonym for every federal court in Abu Dhabi. A person arrested for extradition must be brought before the competent Public Prosecution within 48 hours of arrest; that is not a promise of a court hearing or release within 48 hours.

Which Abu Dhabi authority actually has the file?

Abu Dhabi has local courts administered by ADJD, including courts of appeal and an Abu Dhabi Court of Cassation. The local Public Prosecution investigates and brings criminal matters within its jurisdiction. Separately, federal criminal jurisdiction exists in Abu Dhabi. In a publicly reported extradition matter concerning a request from France, the Abu Dhabi Federal Appeal Court found extradition permissible; the Federal Supreme Court rejected the challenge at a hearing on 14 January 2025. That reported route proves why an address in Abu Dhabi does not by itself identify the reviewing court for a different person. The report does not publish a judgment number or reasoning and should not be used as binding precedent.

Ask counsel to obtain the stamped custody order, the prosecution's name, the court heading, the case or reference number and the next listed hearing. Do not submit an appeal to ADJD solely because the arrest occurred at Zayed International Airport; confirm the issuing court and filing registry first. The UAE country procedure guide explains the federal legal framework beyond this local routing question.

If an arrest happens at Zayed International Airport

Zayed International Airport (AUH) is the main Abu Dhabi airport. ADJD's official branch directory also identifies a Tourist Court and Prosecution at the Zayed International Airport facility. That office exists, but its airport location does not establish jurisdiction to determine a foreign extradition request. The same directory names the Abu Dhabi Citizenship and Residency Court and Prosecution at the federal identity-and-residency authority's building; immigration proceedings should not be mistaken for an extradition hearing.

ADJD's own description assigns its Tourism Prosecution to offences involving visitors and acts in the Abu Dhabi airport transit zone, and says that office operates around the clock. This is a useful point of contact for a separate tourist or transit-zone criminal incident; it is not proof that the Tourism Prosecution controls an international extradition file. Ask which prosecutor actually signed the extradition arrest record before sending applications.

For an airport arrest, record the actual arrest time, flight and terminal, passport used, identity of the arresting authority, and the custody location given to relatives. Request a copy or reference for the arrest basis. An INTERPOL Red Notice is an alert, not a judicial finding that the UAE must surrender the person. The relevant UAE prosecutor must still identify the national legal basis. If police mention immigration removal or deportation rather than a foreign extradition request, ask counsel to verify that separate process; the consequences and safeguards differ. See extradition versus deportation.

In an urgent provisional-arrest situation, Article 15 addresses a 60-day period pending receipt of the formal request and permits release on guarantees. It also describes renewed custody following a request and a separate escape-risk arrest power; 60 days must not be presented as an automatic universal maximum for all extradition detention. Article 16 separately permits the Attorney-General or delegate to order release under specified guarantees after the request is received. A lawyer should identify the specific detention order before contesting its continuation.

Where might a detained person be held, and how can family arrange access?

The ADJD branch directory names the Al Wathba Correctional and Rehabilitation Centre and separately a Correctional and Rehabilitation Centre – Pretrial Detention in the Abu Dhabi region. It also lists a correctional facility in Al Ain, Falaj Hazzaa. These are verifiable facilities, not a claim that any particular extradition detainee has been placed in one of them. Transfers and custody assignments must be checked with the controlling authority; family should not travel to Al Wathba on an assumption.

ADJD's services portal offers an Inmate Visit Permit, Prisoners Inquiries Platform, a detention-period certificate, and a mechanism to add a telephone number for an inmate to contact. Which service can be used depends on custody type, access permissions and whether the detainee falls under ADJD's system rather than a federal authority. A relative can prepare a passport copy, relationship evidence, the detainee's full identity, the case number if known and a reachable phone number. Counsel should determine whether a prosecution permission is needed for an in-person legal visit, a family visit or consular communication. Permission is not guaranteed by the mere existence of an online form.

ADJD publishes guidance on electronic criminal-case requests, UAE Pass access and application tracking through “My Applications”. Its legal-aid FAQ describes assistance, including lawyer fees in qualifying cases after assessment, but does not establish that every foreign extradition detainee will receive an automatically appointed lawyer. If language is a barrier, request interpretation at the first prosecution contact; Arabic is the working language of the proceedings, and UAE criminal procedure provides for interpretation when needed. Ask counsel to inspect the Arabic documents, not just an informal English summary.

What happens after the prosecutor examines the foreign request?

Under Articles 11–12 of the federal cooperation law, a formal foreign request goes through the Ministry of Justice as central authority with supporting material, including identity, the alleged conduct and the foreign judicial basis. Article 18 provides that the Attorney-General forwards the request with a memorandum to the competent court within 15 days after examining the request. That trigger is not the airport arrest, and it is not a guaranteed listing date. Articles 19–20 describe a closed hearing and a reasoned decision on whether extradition is permissible. Article 13 provides a distinct ministerial route on informed written consent in specified single-requesting-state cases; signing consent is not merely waiving attendance at one hearing.

Article 22 of the amended UAE cooperation law gives the parties 30 days from the date the extradition decision is rendered to challenge it; Article 23 provides for a challenge hearing to be set within ten days after filing. Crucially, the controlling Arabic Article 22 says محكمة الطعن المختصة (the competent court for the challenge). The published English translation instead repeats ‘competent Court of Appeal’, even though Article 1 defines the initial extradition court as a competent Court of Appeal. Do not treat that English wording as an instruction to appeal back to the same court. In the reported federal Abu Dhabi case of 2025, the initial federal appellate decision was reviewed by the Federal Supreme Court; that report does not establish the review forum for every locally administered file. A UAE lawyer should check the Arabic ruling, whether its issuing body is federal or local, the applicable superior court and the clerk's correct filing channel immediately. Calendar the 30 days conservatively from pronouncement, not when relatives first hear the outcome. Under Articles 24 and 26, an ordinary surrender decision must be no longer appealable and requires the Minister of Justice's approval before implementation. More detail on objections is in the UAE refusal-and-challenge guide. UAE challenges and refusal guide.

Abu Dhabi, Al Ain and Al Dhafra are not interchangeable filing locations

ADJD's official locations show separate courts and prosecutions serving Al Ain and Al Dhafra, as well as Abu Dhabi-region branches at Al Rahba, Baniyas and Al Wathba. Its Arabic court information also describes appeal circuits in Abu Dhabi city, Al Ain and Al Dhafra. The relevant municipality, arresting unit and jurisdiction noted on the papers therefore matter to where a family makes enquiries. A local branch that handles ordinary criminal or tourist cases should never be assumed to have custody of an extradition file merely because it is geographically close to the arrest.

Hypothetical example: a Georgian transit passenger is arrested at AUH after authorities identify a foreign request. Their sister sees the airport tourist-prosecution listing and plans to file there. The safer next step is for UAE counsel to obtain the arrest reference, identify whether local or federal Public Prosecution is in charge, and confirm the actual Court of Appeal before preparing any hearing submission. If the person is moved to a correctional centre, the sister uses the verified custody location when requesting a visit instead of guessing Al Wathba.

Questions families ask about Abu Dhabi extradition files

Does the airport's Tourist Court decide extradition?

Its existence is verified on ADJD's branch list. No source reviewed gives it exclusive jurisdiction to decide extradition. Obtain the actual prosecution and court reference.

Is everyone detained for extradition at Al Wathba?

No such allocation rule was verified. ADJD lists multiple correctional facilities; ask the authority holding the person to confirm the current location.

Does a Red Notice itself supply an enforceable surrender order?

No. An INTERPOL alert and an extradition permission decision are different instruments, with separate UAE procedures.
