Extradition by country

Extradition Lawyer in Kyiv: Local Courts and Procedure

In Kyiv, extradition detention is decided by an investigating judge of the competent district court, not by the Kyiv Court of Appeal at first instance. The court depends on where the person was arrested for temporary arrest and where the person is held for extradition arrest; an appeal ordinarily goes to the Kyiv Court of Appeal. A prosecutor applies to the judge, while Ukraine's designated central authority handles the foreign request and the eventual surrender decision. The immediate task is to establish the arrest time, exact location, custody facility and order, then obtain local defence assistance before the first hearing.

Which Kyiv court actually has the file?

There is no single Kyiv extradition courtroom. Kyiv still has operating district courts including Pecherskyi, Shevchenkivskyi, Solomianskyi, Holosiivskyi, Darnytskyi and others; the State Judicial Administration's first-half 2026 court statistics list ten Kyiv district courts. A famous court name or the capital-city address of a ministry does not determine territorial jurisdiction. Under Articles 583 and 584 of the Criminal Procedure Code of Ukraine (CPC; Кримінальний процесуальний кодекс України), the relevant location changes with the stage of the case.

InstitutionWhat it doesHow to identify or contact it
District investigating judge (слідчий суддя)Examines the prosecutor's temporary-arrest application after a Kyiv arrest; considers extradition arrest at the place of custody after the formal request arrives.Ask for the arrest report and judicial case number; match the arrest district or detention location to the proper district court.
Kyiv City Prosecutor's Office (Київська міська прокуратура)The official directory lists this city-level office separately from the Kyiv Oblast Prosecutor’s Office. Under CPC Article 582, the prosecutor with territorial jurisdiction over the arrest is notified first, checks the legality of detention and informs the relevant prosecutor’s office; this directory entry does not establish which prosecutor is assigned to an individual case. The official directory lists 45/9 Predslavynska Street, Kyiv, and separately lists the Kyiv Oblast Prosecutor’s Office. Confirm the assigned prosecutor and unit; the address alone does not establish responsibility.
Kyiv Court of Appeal (Київський апеляційний суд)Reviews appealable orders of Kyiv district investigating judges in these proceedings. The official court portal provides case-status and current criminal-chamber contact information; verify the current filing method before sending documents.
Office of the Prosecutor General / Ministry of JusticeCentral extradition authorities: ordinarily the former for suspects or accused persons in pre-trial investigations, the latter for cases at trial or sentence-enforcement stage (CPC Article 574).Check the foreign case stage before addressing any representation about the substantive request.
Kyiv Pre-Trial Detention Centre (Київський слідчий ізолятор)A Kyiv remand facility is listed in an official penitentiary register, but the linked register is dated 2021 and should not be treated as proof of current placement.Confirm the person’s actual custody and current visiting/document-delivery rules through the official Penitentiary Service before travelling; do not assume a person arrested elsewhere is held there.

The ten district courts listed in the official first-half 2026 table are named below in Ukrainian, followed by an identifying transliteration. Match the district in the arrest record to the court’s official name; do not choose a court solely from the family’s address.

  • Печерський районний суд міста Києва — Pecherskyi District Court of Kyiv
  • Шевченківський районний суд міста Києва — Shevchenkivskyi District Court of Kyiv
  • Солом'янський районний суд міста Києва — Solomianskyi District Court of Kyiv
  • Святошинський районний суд міста Києва — Sviatoshynskyi District Court of Kyiv
  • Голосіївський районний суд міста Києва — Holosiivskyi District Court of Kyiv
  • Дарницький районний суд міста Києва — Darnytskyi District Court of Kyiv
  • Деснянський районний суд міста Києва — Desnianskyi District Court of Kyiv
  • Оболонський районний суд міста Києва — Obolonskyi District Court of Kyiv
  • Дніпровський районний суд міста Києва — Dniprovskyi District Court of Kyiv
  • Подільський районний суд міста Києва — Podilskyi District Court of Kyiv

The practical distinction matters in Kyiv because the city has ten district courts and a later custody-based application may be governed by the place where the person is actually held. A transfer does not automatically move every pending case: counsel must check the procedural posture, the court already seised and the venue rule for the particular application. Kyiv city and Kyiv oblast are separate territorial jurisdictions. Boryspil International Airport is in Kyiv Oblast, not Kyiv city; if an arrest occurs there, do not assume that a Kyiv-city district court has territorial jurisdiction merely because the airport is commonly described as serving Kyiv.

As of 25 October 2026, EASA’s Ukraine airspace bulletin remains active through 31 January 2027 and records the Kyiv flight-information region as closed to civil aviation flights. Boryspil should therefore not be presented as a current routine passenger-arrival scenario; if a detention record identifies the airport or nearby territory, the actual location and territorial jurisdiction still control.

The first 72 hours: two legal clocks, not one

Article 582 CPC requires prompt notice to the local prosecutor after an arrest on an overseas criminal case. It further provides for release if the arrested person has not been brought before an investigating judge within 60 hours from detention. Article 583(5) requires the temporary-arrest application to be heard as soon as possible and no later than 72 hours from detention. These are different requirements: neither means a family should wait until hour 60 or 72 to obtain counsel.

When / eventKyiv actionWhy it matters
Immediately after detentionRecord the actual arrest time, arresting service, district, reason given and location; request an interpreter and confidential counsel. The statutory clocks run from detention, not from a later transfer or family notification.
Before the 60-hour presentation limitFind which Kyiv investigating judge is to receive the person; verify that the prosecutor has the detention report.Article 582(6) sets a release consequence for failure to bring the person to the judge in time.
No later than 72 hours for the Article 583 hearingHave counsel inspect the application and available documents, correct identity or citizenship errors, and oppose unsupported detention. The judge decides temporary custody, not the merits of the foreign prosecution.
After the foreign request is receivedCheck whether a new Article 584 extradition-arrest application is filed before the judge at the place of custody.A temporary-arrest order is not an indefinite authority to detain.

Hypothetical Kyiv example: a Georgian national is detained by police in the Pecherskyi district on an international request. Counsel should first verify whether the Pecherskyi district court has the temporary-arrest application. If the person is later held at the Kyiv Pre-Trial Detention Centre in Shevchenkivskyi district, counsel must check the custody-location rule before filing an Article 584 review. These are illustrative facts, not a report of an actual case; the arrest report and custody record control.

What can the judge decide about continuing detention?

For a temporary-arrest application, Article 583 ordinarily permits detention for up to 40 days while the formal request is awaited, unless the applicable treaty sets a different period; if the request does not arrive within the applicable maximum, release from that temporary arrest is required. A later Article 584 extradition-arrest application is a separate measure and is tied to the place of custody. At the first hearing, the investigating judge does not try guilt in the foreign case. The Ukraine extradition guide explains the national sequence; the Ukraine remedies guide covers refusal grounds and challenges.

Kyiv Court of Appeal: which orders can be challenged?

Appeals permitted by Chapter 44 from a Kyiv district investigating judge are heard by the Kyiv Court of Appeal. For an appealable investigating-judge ruling, the general period is five days: normally from pronouncement, from service of the copy for a person in custody, or from receipt of the copy if the ruling was made without summoning the person who appeals (CPC Article 395). A challenge to the central authority’s final extradition decision is different: under Articles 590(3) and 591, file the complaint within ten days after service of the decision with the investigating judge where the person is held, except for the simplified procedure under Article 588; the judge considers it within five days after the court receives it. Do not confuse this with a detention-order appeal, and do not assume every extradition-related order is appealable: the Supreme Court held in case No. 947/23713/22 (31 August 2023) that refusal of house arrest under Article 585 is not separately appealable merely by invoking Article 309. See the Ukraine remedies guide for refusal grounds and the full remedy analysis.

Language, prison access and a useful family checklist

Article 584(5) requires an interpreter when the person does not understand Ukrainian at an extradition-arrest hearing, and Article 584(3) addresses translation of documents lodged with the investigating judge. The person should tell counsel precisely which language and dialect they understand. Do not sign an unexamined declaration of consent to expedited extradition or waiver of the speciality rule (the usual limit on prosecution for other offences after surrender): those are separate choices with potentially different legal effects, and certain consent-related orders cannot be appealed.

The official penitentiary register linked below is dated 2021; do not use it as proof of current placement. Confirm the actual facility and its current visiting/document-delivery rules through official channels.

  • Send the local lawyer the detainee's full name in original script, date of birth, citizenship(s), passport image if available and preferred language.
  • Write down the precise time and district of detention, responsible police unit, case number and name of the prosecutor if known.
  • Ask for copies of the detention report, temporary-arrest order, later extradition-arrest order and proof of any transfer between facilities.
  • Locate the custody institution before sending authorised counsel to arrange a confidential visit and examine interpreter needs.
  • Preserve the delivery envelope, signature and date if a central-authority extradition decision has been served: it starts a different urgent court question.
  • Have foreign counsel transmit accurate court papers and custody orders through defence channels; identify the requesting state and procedural stage rather than relying on a Red Notice headline.

Where to act if the person has moved out of Kyiv

A transfer does not automatically move a pending appeal from a Kyiv district order to a different appellate court. For a new Article 584 custody application or Article 591 challenge, obtain the current custody record and confirm the district court with territorial jurisdiction over the actual facility; Article 591 has the Article 588 simplified-procedure exception noted above. The official directory lists the Kyiv City Prosecutor’s Office separately from the Kyiv Oblast Prosecutor’s Office, so confirm the assigned prosecutor rather than inferring it from the city name. For national procedure beyond this local venue check, use the Ukraine extradition guide.

Questions families ask in Kyiv

Can a relative file at the Kyiv Court of Appeal immediately?

Usually the first issue is heard by the competent district investigating judge. A lawyer can assess the appealable order and submit the appropriate appeal to the Kyiv Court of Appeal.

Does 40 days mean the whole case must finish?

No. It usually concerns temporary arrest while waiting for the formal foreign request; extradition arrest is a separate judicial measure with its own limit and reviews.

Is a Red Notice the same as a judicial extradition order?

No. The Ukrainian prosecutor, investigating judge and competent central authority still have distinct tasks, and the underlying documents must be checked.

Can a Kyiv lawyer act if the detainee is in Kyiv oblast?

Counsel can coordinate representation, but must verify the investigating judge and court territorial jurisdiction in the actual arrest and custody locations.
