Extradition Lawyer in Lutsk: Volyn Court of Appeal and the Local Procedure

In Lutsk, a prosecutor normally asks an investigating judge of the competent local court to decide whether a person sought abroad may be held; the Volyn Court of Appeal (Волинський апеляційний суд) reviews appealable judicial orders, but does not itself make Ukraine's executive extradition decision. For an arrest in the city, the starting point is usually the Lutsk City-District Court (Луцький міськрайонний суд Волинської області). An arrest at a Volyn border crossing is not automatically a Lutsk-court case: the place of arrest and, later, the place of custody determine different applications.

Which Lutsk institution should the family contact?

The essential first task is to identify the precise type of paper: a police detention record, a prosecutor's motion for temporary arrest, an order for extradition arrest, or a central authority's decision to surrender. They involve different decision-makers and review routes. Asking the Volyn appellate court to make the first detention order, or sending a challenge to an overseas warrant there, risks missing the actual hearing.

Lutsk City-District CourtAn investigating judge considers a temporary-arrest request when the arrest occurred within that court's territorial jurisdiction; a later extradition-arrest request follows the place of custody. The court lists 3 Koniakina Street. Its February 2026 contact notice gives (0332) 28-38-70 for criminal proceedings. Confirm the hearing building and room before travelling.

The contact notice gives (0332) 72-22-04 for civil and administrative matters; call to confirm the location of the particular hearing.
Volyn Court of AppealHears appeals from appealable orders within its circuit; it does not make the executive decision to extradite.10 Chervonoho Khresta Street, Lutsk; use the official court site to confirm current filing and access arrangements.
Volyn Regional Prosecutor's Office (Волинська обласна прокуратура)Part of the statutory reporting chain: the local prosecutor informs the regional prosecutor's office, which must notify the Ukrainian central authority within 60 hours of arrest. No extradition-specific intake desk was verified.15 Vynnychenka Street is listed on the Prosecutor General's registration-point page; that listing is not an extradition hotline or confirmation of where to file a case.
Lutsk Remand Centre (ДУ «Луцький слідчий ізолятор»)A listed custody facility, but no inference should be drawn that a particular detainee is held there; confirm placement directly.3 Nestora Burchaka Street, Lutsk, in the official detention-facility directory; confirm actual placement and visiting rules.

The court publishes two addresses, but its official pages do not reliably assign every hearing type to one building. The separate contact notice gives numbers by department, not a guarantee of the hearing venue. Before travelling, ask the court to confirm the case number, address and room; an address in a directory does not prove that a particular detainee is held there or that a hearing will take place at that site.

Why do Yagodyn and Ustyluh arrests require a different court check?

Volyn has the Yagodyn–Dorohusk and Ustyluh–Zosin road crossings with Poland. A Volyn regional-authority page lists both pairs, but it is not dated in a way that confirms their current operating status; verify opening and travel conditions on the day of travel. The family's first message should record which side, crossing, checkpoint building, authority and exact time were involved. Polish custody and Ukrainian custody are different legal situations: this page addresses detention by Ukrainian authorities only.

For temporary arrest under Criminal Procedure Code (CPC) Article 583(3), the prosecution applies to the investigating judge with territorial jurisdiction over the place of arrest . Thus a person stopped at Yagodyn or Ustyluh should not have their first hearing assigned to Lutsk simply because Lutsk is the regional capital. Once the person is actually held in a detention facility, Article 584(1) directs the subsequent extradition-arrest application to the judge where the person is held . This change in territorial connecting factor is the local procedural issue that families and foreign lawyers must verify before lodging papers.

What happens in the first 72 hours after a Ukrainian arrest?

This is a statutory timetable for the initial detention stage, not a promise of a full extradition hearing within three days. CPC Article 582 requires the arresting authority to notify the local prosecutor immediately. Under Article 582(4), the regional prosecution must inform the Ukrainian central authority within 60 hours from arrest; the central authority then has three days to inform the foreign authority. Separately, Article 582(6) requires release if the person is not brought before an investigating judge within 60 hours of arrest, subject to the statutory circumstances. Article 583(5) requires the temporary-arrest request to be determined as soon as possible and no later than 72 hours from arrest. Record the actual hour and minute, not just the calendar day.

Before a formal request arrives, Article 583 permits temporary arrest for up to 40 days, unless the applicable treaty supplies another period. Arrival of the formal request can lead to a different order, extradition arrest, rather than automatic continuation of temporary arrest. These are not the same judicial order. Ukraine's central authorities, ordinarily the Office of the Prosecutor General for pretrial matters and the Ministry of Justice for trial or sentence matters under Article 574, decide whether to grant extradition, not the Volyn Court of Appeal.

If the person is held in Lutsk, which remedies are heard where?

When custody is in Lutsk, counsel should verify that the facility is indeed the Lutsk Remand Centre on Nestora Burchaka Street and request the court order authorising custody. Under Article 584(10) extradition arrest cannot exceed 12 months; under Article 584(11) the investigating judge at the place of custody reviews continuing grounds on a prosecutor's motion at least once every two months. The person or defence may seek judicial review of grounds for release under Article 584(12), not more than once per month. This is a custody review, not a determination that the requesting state's prosecution is unfounded.

Ordinary temporary-arrest and extradition-arrest orders are in principle appealable to the appropriate appellate court, in Lutsk cases typically the Volyn Court of Appeal. But Articles 583(7) and 584(9) explicitly exclude appeals against specified orders approving consent to simplified extradition together with arrest. The general appeal period for an investigating judge's appealable order is five days from pronouncement under Article 395(2)(3); for a detained person Article 395(3) calculates it from service of the copy. Counsel must inspect the exact operative part of the order before assuming that route is open. Chapter 44 lists the orders that may be appealed; do not assume that every extradition-related order, especially an order extending a non-custodial measure, is appealable.

A further and separate remedy concerns the central authority's decision to extradite. Under Articles 590–591, a person may generally challenge that decision before the investigating judge for the territory where the person is held; if the person is subject to a non-custodial measure, Article 591 instead points to the territory where the relevant Ukrainian central authority is located. Important exception: Article 591(1) excludes the ordinary complaint route for a case covered by the simplified procedure in Article 588. Do not assume that a complaint remains available after court-approved consent to simplified extradition.

Article 590 provides that, after the decision's copy is served, actual surrender is organised if the decision is not challenged in court within 10 days. Article 591 requires the investigating judge to hear a complaint within five days from its receipt by the court. The judge does not decide whether the person is guilty or review the legality of the requesting state's procedural decisions. An appeal against the investigating judge's ruling is available under Article 591(6), and filing it suspends the ruling's entry into force and execution. Do not assume there is a general third, cassation appeal: Article 591(7) permits cassation of the appellate ruling only by a prosecutor, on specified international-treaty grounds, where setting aside the extradition decision prevents further proceedings. This is distinct from an appeal against a detention order. Full refusal grounds and further avenues are dealt with in the Ukraine remedies guide.

What should be arranged before contacting a Lutsk lawyer?

  • Establish location: obtain the police unit, precise checkpoint if relevant, custody facility, court case number and current hearing date. Transfers can change the competent investigating judge for custody matters.
  • Protect communication: request a confidential lawyer meeting and an interpreter where Ukrainian is not understood. Article 584(5) specifically requires an interpreter at an extradition-arrest hearing for a person who does not know the state language.
  • Secure papers: collect citizenship and identity documents, the Ukrainian detention protocol and order, the foreign warrant details, and service dates of every judicial or central decision.
  • Check representation: a family member may inform Ukraine's free legal-aid contact centre at 0 800 213 103; detention reports are accepted around the clock. Confirm appointment with the responsible system rather than assuming any named individual is the duty lawyer.
  • Flag immediate needs: medication, injuries, disability or a child left without care. Article 584(15) addresses child-protection notification where a dependant child would otherwise lack parental care.

Hypothetical example. A foreign national is stopped by Ukrainian officers at Yagodyn while travelling on a coach. The relative in Lutsk asks the city court whether tomorrow's temporary-arrest hearing is scheduled there. The correct first question is where the arrest formally occurred and which local investigating judge received the prosecutor's Article 583 motion. If the person is later transferred to the Lutsk Remand Centre and the formal foreign extradition request arrives, the Article 584 application will be assessed by the judge competent for the place of custody. Neither step is an appeal against the Polish authorities nor proof of an automatic surrender.

Ukraine is a party to the European Convention on Extradition (ETS 024), subject to its reservations and declarations and the requesting state's treaty position. In its 18 April 2022 notice to the Council of Europe, Ukraine said it could not guarantee full performance of certain treaty obligations during the armed aggression and martial law. On 7 December 2023, Ukraine clarified that the treaties listed in that notice are implemented in full in Ukraine except in territories where hostilities are or have been conducted or which are temporarily occupied. The 2022 notice should therefore not be read as a blanket suspension across all of Ukraine. Because Ukraine is not an EU member, a European Arrest Warrant is not the mechanism for executing a Polish or another EU Member State's warrant in Ukraine. Check the treaty applicable to the particular request; the general procedure is explained in Extradition from Ukraine.

Practical questions in Lutsk

Does the Volyn Court of Appeal decide to hand someone over to Poland?

No. It hears appeals within its jurisdiction. The Ukrainian central authority makes the extradition decision, which may then be judicially challenged under the applicable procedure.

Does a detention at the Yagodyn crossing necessarily go before a Lutsk judge?

No. For temporary arrest the statutory connecting point is the place of arrest; for later extradition arrest it is the place of custody. Confirm both before addressing an application.

Can relatives visit the Lutsk Remand Centre without confirming custody there?

They should first verify the current institution and its visiting rules. The institution exists in Lutsk, but being arrested in Volyn does not establish that the person has been admitted there.

Will a lawyer be able to challenge a consent-based arrest order?

Not always: Articles 583 and 584 exclude appeals of certain consent-approval orders. Obtain advice and an interpreter before deciding whether to consent or separately waive specialty protection.
